Plaruung Cominission Report <br />Silver Lake Commons Amended Development Review <br />Pianning Case No. 487-97 and 504-97 <br />Septen�ber 3, 1997 <br />Page 5 <br />Park Dedication RequrYernents_ <br />Section 1204.02 of the Mounds View Municipai Code requires that any subc�ivider of land shall <br />make a payment to the City for partc dedication purposes in an amount set forth by the Code. For <br />residentiai developments, the fee is based on gross density, or in other words, dweliing ur�its pe� <br />acre. For develop�nents having gross densities in excess of 5 dweliing units per acre, t�� ��� is <br />and amouni equal to tet� percent of the fair market value of the land being subdivided. St�f� <br />presumes that an appraisal of �he vacant lots was performed for this development a�d wili seek to <br />gain a copy of this appraisal before yo�ar meeting. Staff will require that the appro��i��� p�y����$ <br />be made prior to action of this request by the City Council. <br />Easements: <br />Sta#�'has requested that easements be dedicated for drainage and utility purposes or� the corribir�ed <br />lot along the property lines and over any area set aside for panding or water retention. Ten feet <br />wili be required along the front and rear properiy lines and five feei for the side proper°ty lines. <br />These easement areas are shown on the Certificate of Survey, with the exception o£the ponding <br />or retention area, pending the City Engineer's review. These easerrtents shall be exe�ut�d by <br />means of a documeni to be recorded with Ramsey County prior to the Mayor's and th� �iiy <br />Administrator's signatures appearance on the Certificate of Survey. <br />Chan es to urve�!: <br />Staff has requested that the Certificate of Survey be amended prior to City Council action on this <br />reauest to reflect the addition of three things. First, the title "Certificate of Survey" �ka�il be <br />added to the survey. Second, a signature btock bearir�g the names of the Mayor, Duane McCarty, <br />and City Administrator, Charles Whiting; in addition to the name(s) of the property owners of the <br />development shali be added to the survey. Last, a block of te�ct shaII be added to the sutvey <br />wi�ich states: <br />"A separate easerrrent document, Docr�ment No. , has been recorded tivath <br />Ramsey County on this _ drry of , 1997 which peppetually dediccates those <br />areas so designuted on this cer°tifrcate, f°or ci�afnage and utidity purposes ta th� C.z� � f <br />Mou�ds View. " <br />Qther Issues: <br />There are two problems as a resuit of this minor subdivision that staff recently uncovered.
