<br />(e <br /> <br />ADMINISTRATIVE POLICY 91 - 1 <br /> <br />FORFEITURE/EOUITABLE SHARING PROGRAM <br /> <br />Philosophy <br /> <br />The purpose of this Administrative Policy is to set forth the <br />city's policy concerning the application and usage of funds <br />acquired under the Federal and State Forfeiture/Equitable Sharing <br />Program. <br /> <br />The intent of this policy is to establish guidelines for the <br />application, usage, investment, and auditing of funds obtained <br />within this program. <br /> <br />The City believes that the acqu~r~ng, expenditure, and management <br />of funds obtained through the Forfeiture/Equitable Sharing <br />Program provides additional opportunities to supplement the <br />Police Department'sbudget. This policy does not apply to funds <br />otherwise acquired and approved outside of this program. <br /> <br />ApPlicabilitv: <br /> <br />',~~he provisions of this policy are applicable to: <br />~l!.~J; <br /> <br />All funds and/or other property acquired consistent with <br />Federal and State Forfeiture and Equitable Sharing laws. <br /> <br />stipulations: <br /> <br />1. Application for funds and/or property available under the <br />Federal or State Forfeiture/Equitable Sharing program shall <br />be made under the direction of the Chief of Police. <br /> <br />2. Funds and/or property seized under this program shall be <br />used consistent with Federal and State guidelines and only <br />for law enforcement purposes. <br /> <br />3. Funds not being actively used shall be invested consistent <br />with City policy and applicable State laws and at the <br />direction of the Director of Finance and the Chief of <br />Police. <br /> <br />4. <br /> <br />The city's Purchasing Policy shall apply to expenditures of <br />funds acquired under the Federal or State Forfeiture/ <br />Equitable Sharing Program with the exception that for <br />purposes of determining applicability of the purchasing <br />policy purchases of $5,000 and under are considered to be <br />budgeted purchases. <br /> <br />(. <br /> <br />5.
