Mounds View City Council November 23, 2015 <br />Regular Meeting Page 3 <br /> <br /> Ayes – 4 Nays – 1 (Mueller opposed) Motion carried. <br /> <br />Public Works Director Erickson discussed the appeal request from 2110 Terrace Drive in detail <br />with the Council. There was concern with the high groundwater elevation on the property in <br />addition to the location of underground utilities. Staff requested the Council take comments <br />from the public and uphold the recommendation of denial of the appeal. <br /> <br />Benedict Speldrick, 2110 Terrace Drive, expressed concern that his basement would flood if an <br />infiltration basin was located in his front yard. He noted the location of the outlet for the <br />infiltration stating it ran through his yard past his garage. He did not want his garage adversely <br />impacted by water runoff either. Public Works Director Erickson noted the location of the catch <br />basin stating it was to the east of Mr. Speldrick’s driveway. He reported staff would have to <br />further investigate the site to see where the utility easement was located. <br /> <br />Mayor Flaherty asked if the Council wanted to proceed with this appeal or wait until further <br />information was gathered by staff. <br /> <br />Council Member Gunn supported moving forward with the appeal and noted the catch basin sites <br />were recommended by the City Engineers. <br /> <br />MOTION/SECOND: Flaherty/Meehlhause. Approving the Denial of Stormwater Infiltration <br />Program Appeal # 81 for the property at 2110 Terrace Drive within Area I of the Street and <br />Utility Improvement Program. <br /> <br />Council Member Meehlhause recalled that in the five years he has attended City Council <br />meetings, he recalled only one appeal was approved. <br /> <br /> Ayes – 4 Nays – 1 (Mueller opposed) Motion carried. <br /> <br />MOTION/SECOND: Gunn/Hull. To Waive the Reading and Adopt Resolution 8482, Consider <br />Stormwater Infiltration Program Appeals for Area I of the Street and Utility Improvement <br />Program. <br /> <br /> Ayes – 4 Nays – 1 (Mueller opposed) Motion carried. <br /> <br />A. Second Reading and Adoption of Ordinance 910, an Ordinance Approving a <br />Cable Franchise Agreement with CenturyLink (ROLL CALL VOTE). <br /> <br />City Administrator Ericson stated that was the second time this Ordinance was before the City <br />Council. It was noted the Council introduced Ordinance 910 at their November 9th meeting. He <br />reviewed the proposed Cable Franchise Agreement with CenturyLink further with the Council <br />and recommended approval. <br /> <br />Council Member Mueller asked if the City would be collecting a franchise fee from CenturyLink. <br />City Administrator Ericson reported this would be the case.
