<br />WHEREAS, the City Council has reviewed the following:
<br />1. Staff Report, dated December 11, 2017
<br />2. Correspondence from residents, included in the December 11, 2017 Staff Report
<br />3. `Boulevard Mounds View, Minnesota Issued for: City Resubmittal", dated December
<br />1, 2017, and architectural plans, dated November 8, 2017.
<br />4. Traffic Study, dated June 29, 2017
<br />NOW, THEREFORE, BE IT RESOLVED, the City Council finds that the request is
<br />consistent with the City of Mounds View Municipal Code, Title 1000 (Building and
<br />Development Regulations), Title 1100 (Zoning Code), and the Comprehensive Plan; and,
<br />NOW, THEREFORE, BE IT FINALLY RESOLVED, based upon the above findings,
<br />the information and documents regarding the proposed plans within the Staff Report, and
<br />testimony of the applicant, and in consideration of public testimony, the City Council does
<br />hereby approve of the Development Review of "Boulevard", with the following conditions:
<br />The applicant, MWF Properties, LLC, shall construct the project consistent with the
<br />December 1, 2017 plan set, inclusive of "Boulevard Mounds View, Minnesota Issued for:
<br />City Resubmittal ", dated December 1, 2017, and architectural plans, dated November 8,
<br />2017.
<br />2. The Developer shall satisfy all requirements of the City Engineer (Stantec), as stated in its
<br />review comments, dated Nov 27, 2017.
<br />Exterior appearance of the building shall be consistent with the rendering, included in the
<br />December 11, 2017 Staff Report.
<br />4. Any exterior lighting within the development which casts light trespass onto neighboring
<br />residential properties in excess of that allowed by the Municipal Code shall be mitigated,
<br />if requested by the adjacent property owners. This is specific to (but not limited to) the
<br />property owner of 2825 Mounds View Blvd. Any mitigation shall occur prior to the City
<br />returning its escrow.
<br />The applicant, MWF Properties, LLC, shall submit an escrow or letter of credit for
<br />landscaping in the amount of 150% of the cost of materials and labor, or $10,000
<br />(whichever is less) to the City of Mounds View. The escrow or letter of credit may be
<br />returned one-year after the date of Certificate of Occupancy and upon site inspection by
<br />staff. Upon staff's inspection, if landscaping is in need of replacement, a proportionate
<br />amount of the escrow or letter of credit may be retained by the City until one-year after
<br />landscape replacement and survival.
<br />6. The applicant, MWF Properties, LLC, shall obtain all applicable permits from the City of
<br />Mounds View, Ramsey County, Rice Creek Watershed District, and other applicable
<br />agencies.
<br />7. The Developer shall obtain applicable permits from the Rice Creek Watershed District
<br />(RCWD), and submit a signed/recorded copy of the Maintenance Agreement for storm
<br />water management facilities to RCWD.
