3.3 Fire Department agrees to furnish the building inspection,plan review, and site <br /> review services and necessary personnel as requested by the City to the said designated areas in <br /> the City, for the consideration set forth below, and agrees that its building inspection personnel <br /> will make every <br /> reasonable effort to respond to requests from the City for inspection services. <br /> 3.4 Fire Department agrees to the position description and performance of the duties <br /> as described on ATTACHMENT A of this document. <br /> ARTICLE IV. COMPENSATION <br /> 4.1 Payment for the services provided by the Fire Department to the City shall be as <br /> follows: <br /> (a) The City will pay Fire Department a maximum of$40,000 per year, $5000 of <br /> which is due by January 1 of each contract year. The $5,000 due is a non refundable fee for <br /> administrative expenses, and not applied to any work performed. The remainder will be billed <br /> throughout the year as work is performed. <br /> (b) The annual cost to the City for such services shall not exceed $40,000 (a figure <br /> based on historical numbers of plan review and inspections)unless said activity increases by <br /> more than a ten(10%) margin, at which time the Fire Department and the City could renegotiate <br /> a compensation package. <br /> (c) Payment for services shall be made upon the presentation of billing statements to <br /> the Municipality. The Municipality shall make payment to the Fire Department within thirty <br /> (30) days of its receipt of the billing statement or make reasonable arrangements for payment <br /> acceptable to the Fire Department. <br /> 4.2 The Fire Department agrees to submit to the City a copy of the Fire Department's <br /> annual financial report as prepared by its certified public accountant no later than June 30 of each <br /> year. <br /> ARTICLE V. DEPARTMENT ORGANIZATION <br /> 5.1 The Fire Department agrees to remain at all times a non-profit corporation under <br /> Minnesota Statutes 317.17. <br /> 5.2 The Fire Department shall at all times be in compliance with such equipment, <br /> personnel and training standards relating to building inspections as may be required by the laws <br /> of the State of Minnesota and the Federal Government. <br /> 5.3 The Fire Department agrees to have one or more I.C.B.O certifications, including <br /> but not limited to plans examiner, combination inspector, as well as Minnesota Building Official <br /> n:\users\caris\build.con Mounds View Building Inspector Contract-Draft 3-2/12/99 <br />
