Mounds View City Council August 23, 1999 <br /> Regular Meeting Page 14 <br /> Planning Associate Ericson stated this item was heard by the Planning Commission, at four prior <br /> meetings. He stated the Planning Commission, the applicant, staff, and several residents had <br /> discussed the issues,bringing forward a number of concerns to the City and the neighborhood. He <br /> stated there was extensive discussion with regard to parking on the site,traffic circulation, taxes, and <br /> other site related concerns as to whether or not this type of use would be appropriate at this location. <br /> He stated a great deal of time had been devoted to this discussion, and as Council Member Marty <br /> had indicated, the Planning Commission worked very hard on this issue. <br /> Planning Associate Ericson stated the two issues for consideration were the rezoning request, and <br /> the conditional use permit request. He stated the conditional use permit could be accomplished with <br /> a resolution, which would be drafted, pending the Council's discussion and direction to staff. He <br /> stated the rezoning would be accomplished through an ordinance,which would require two readings. <br /> He stated an ordinance has been drafted for the Council's consideration, and the public hearing had <br /> been scheduled for the present meeting. He stated the Council could determine whether or not they <br /> would entertain the reading of the ordinance at this time. <br /> Planning Associate Ericson stated staff had reviewed the tax issues and discussed them with the <br /> Ramsey County Tax Assessor's office. He stated this was in regard to the effects of the proposed <br /> use on the tax base, and whether or not a commercial use would generate more tax dollars. He stated <br /> it was determined that the proposed use would quite possibly generate more to the City's tax base <br /> than a retail use, which would be permitted in the B-2 Zoning District. He stated the applicant has <br /> indicated the valuation of the project would be approximately 1.5 million dollars. He stated, should <br /> that be the case, the City could be acquiring a significant tax base with this proposal. <br /> Planning Associate Ericson stated, with regard to the rezoning request, the Planning Commission <br /> had requested there be a mechanism to revert the zoning of the property to the commercial <br /> designation if the proposed use did not go forward. He explained that Ordinance 631, presently <br /> before the Council, contained a clause in Section 3, which proposes that, in the event this project <br /> does not proceed, the City Council may act to rezone the property back to its original zoning <br /> designation. He stated this matter had been reviewed by the City Attorney, who indicated that the <br /> language was in proper legal form, and would not create a situation in which the Council would be <br /> obligated to act. <br /> Planning Associate Ericson stated there are some specific site requirements, in terms of the <br /> conditional use permit,regarding side yards, side yard setbacks, and other similar matters. He stated <br /> all of these criteria could and will be met. He stated one other action that would be required prior <br /> to this request coming to fruition, would be that the developer would be required to come before the <br /> City again in the form of a Development Review, and this process would clarify all of the site- <br /> specific requirements. He stated, at that time, the City would review sidewalks, the parking access <br /> to the property, and the layout and elevation of the proposed facility.
