Previous Approvals: <br /> On May 12, 1997 the City Council approved Resolution No. 5104 which changed the <br /> comprehensive plan designation of the subject site from Medium Density Residential to Mixed <br /> Use PUD (Commercial and Residential Uses). The City Council on the same night gave first <br /> reading to Ordinance No. 598 which rezoned the site from B-1 Neighborhood Business and R-2 <br /> Single and Two Family Residential to PUD for commercial uses. Resolution No. 5119 was also <br /> approved on May 12, 1997 which approved a General Concept PUD Plan for the site. Second <br /> reading and passage of Ordinance No. 598 occurred on May 27, 1997. Copies of the approved <br /> resolutions and ordinance are attached for your information. <br /> PUD Approval: <br /> There are three steps to approval of a PUD. These include general concept plan, development <br /> stage plan, and final plan. As indicated above, the city has previously approved a general concept <br /> plan. The applicant has now submitted a development stage plan for city approval. 1120.04 <br /> Subdivision 3 of the Municipal Code outlines the procedure for development stage plan <br /> approval. The code states that the Planning Commission shall review the plan and submit a <br /> written report and recommendations to the City Council with respect to the conformity of the <br /> development stage plan to the general concept plan, with respect to the merit or lack of merit of <br /> any departure of the development stage plan from substantial conformity with the concept plan, <br /> and with respect to the compliance of the development stage plan with the provisions of this Title <br /> and other applicable Federal, State and local codes and ordinances. No public hearing before the <br /> Planning Commission is required by the City Code. Within 30 days of receipt of the report and <br /> recommendations of the Planning Commission,the City Council shall conduct a public hearing <br /> on the plans. Thereafter, the City Council may grant approval, resubmit the plan to the Planning <br /> Commission for further consideration or deny approval of the plan. If the City Council does not <br /> take action on April 27, 1998 to approve or deny the plan, action must be taken to extend the 60 <br /> day approval period of the plans will automatically be approved in accordance with state statutes. <br /> 1120.04 Subdivision 3f. outlines the review and evaluation criteria for development stage plans. <br /> The following is a summary of staff's review and findings: <br /> 1. Adequate property control is provided to protect the individual owner's rights <br /> and property values and the public responsibility for own maintenance and <br /> upkeep. <br /> Both the developer and the property owner have signed the application. The <br /> developer will be leasing the property and will purchase the property upon the <br /> death of the owner. The PUD will provide adequate requirements for <br /> maintenance.Criteria Met <br /> 2 <br />
