important role that wetlands play in maintaining the ecosystem and the area hydrology, in that <br /> they are critical to the present and future health, safety and general welfare of the land, animals <br /> and people within the City. Any existing and potential development within the City and the Rice <br /> Creek Watershed pose increasing economic and ecologic demands,potentially despoiling, <br /> polluting or negatively altering wetlands and their contributory function and benefit to the City. <br /> According to Chapter 1010 of the Municipal Code relating to the Wetland Zoning District and <br /> the recently-adopted Ordinance No. 602 amending Chapter 1010, any work occurring within the <br /> 100-foot buffer surrounding a wetland or within a wetland itself requires either a wetland buffer <br /> or wetland alteration permit. In addition, approvals must be obtained from Rice Creek <br /> Watershed District,the local government regulatory agency overseeing wetlands and other <br /> hydrological features. <br /> As discussed previously, portions of the project encroach into the required 100 foot buffer <br /> around the deliniated wetland on the site. Specifically,the following encroachments are <br /> proposed: <br /> 1. A stormwater pond will be 15 feet away from the deliniated boundary. <br /> 2. A trash compactor will be 90 feet away from the deliniated boundary. <br /> 3. The theater building will be 15 feet away from the delineated boundary. <br /> 4. A concrete transformer pad for the theater will be 35 feet from the delineated <br /> boundary. <br /> 5. The trash enclosure for the future retail building is shown 20 feet away from the <br /> deliniated boundary. <br /> 6. Parking for the future retail building is shown 53 feet and 75 feet away from the <br /> delineated boundary. <br /> 7. A concrete transformer pad for the future retail building is shown 50 feet from the <br /> delineated boundary. <br /> 8. The future retail/restaurant building is shown 15 feet away from the delineated <br /> boundary. <br /> 9. The sidewalk/pathway along the north side of the wetland is shown 3 feet from the <br /> delineated boundary. <br /> 10. The future restaurant building is shown 35 feet from the delineated boundary. <br /> 11. The trash enclosure for the future restaurant building is shown 30 feet from the <br /> delineated boundary. <br /> 12. Parking for the furture restaurant building is shown 15 feet from the delineated <br /> boundary. <br /> Analysis: <br /> Staff has reviewed the proposed development stage plan and has found that the development <br /> stage plan is generally consistent with the approved concept plan. Variations for the most part are <br /> improvements to the plan and will not adversely affect adjacent properties. The exception would <br /> be that the higher light standards may be more visible from the adjacent residential areas. The <br /> developer has agreed to complete a sight line study to determine if the proposed 40 foot high <br /> light standards would be visible from the adjacent residential area to the south.
