• <br /> MEMORANDUM <br /> TO: Bruce Kessel <br /> FROM: Scott Riggs <br /> DATE: March 20, I998 <br /> RE: Necessary Changes to Permit Beer Garden <br /> Bruce: <br /> Per your request, here is a summary memorandum of the issues involved and/or changes <br /> necessary to permit a "beer garden" on City park property. Please note that I have also briefly <br /> discussed this matter with Chuck Whiting. <br /> In order to facilitate the Festival-in-the-Park "beer garden," changes to the following Municipal <br /> • Code sections appear to be required, depending upon what type of license the event sponsor <br /> desires: <br /> Code Section 909.07, Subd. 11 would have to be modified to permit alcoholic beverages <br /> in whatever City park is to be utilized for the event. <br /> The City's Code Section 50 <br /> no longer 50103, Subd. 3, as to temporary non-intoxicating [this term is <br /> permitted by state statute and should be changed to "3.2 percent malt liquor." <br /> see Minn. Stat. § 340A.411. Subd. 3] license would have to be possibly modified as to <br /> the length of time the entity requesting the license has been in existence (a requirement <br /> not found in state statute) and possibly as to the location of the event. See Minn. Stat. <br /> § 340A.403. Subd. 2]. <br /> Code Section 502.03. Subd. 6. as to a temporary intoxicating liquor special event license <br /> would have to be modified possibly as to the location of the event. Please note however, <br /> that the length of time the entity requesting this license has been in existence cannot be <br /> less than three (3) years for this license based upon the City Code and state statute. See <br /> Minn. Stat. § 340A.404, Subd. 101.
