Mounds View City Council July 14, 2014 <br />Regular Meeting Page 6 <br /> <br />Mayor Flaherty feared that Mounds View would be open to litigation if the moral character 1 <br />language remained in the City Code. He indicated he would like to discuss this item further with 2 <br />the City Attorney. City Administrator Ericson commented City Attorney Riggs would be present 3 <br />at the next Council meeting. 4 <br /> 5 <br />Council Member Meehlhause asked if all tobacco establishments had video surveillance devices. 6 <br />Assistant City Administrator Crane believed this to be the case. 7 <br /> 8 <br />Mayor Flaherty explained that if the Ordinance were approved, each tobacco license holder in the 9 <br />City would have to be brought into compliance with the new language. He recommended the 10 <br />language regarding small bags be reworded to allow for the sale of sandwich bags. He agreed 11 <br />that the City should not be regulating cigar prices in Mounds View. City Administrator Ericson 12 <br />stated it was staff’s intent to bring all tobacco license holders into compliance. 13 <br /> 14 <br />Council Member Mueller believed that addressing loitering in front of tobacco and liquor 15 <br />establishments in the City would improve safety. She appreciated the report from the Ramsey 16 <br />County Tobacco Coalition along with the proposed language changes to the tobacco code with 17 <br />the revisions discussed. 18 <br /> 19 <br />Council Member Hull asked how many compliance checks were completed in the City each year. 20 <br />Assistant City Administrator Crane reported the Police Department conducted four compliance 21 <br />checks annually. 22 <br /> 23 <br />Mayor Flaherty recommended the Council and staff keep in mind that the amendment should be 24 <br />written to apply to all tobacco businesses and not just Sam’s Market. He suggested that the City 25 <br />be prepared to enforce the language within City Code. 26 <br /> 27 <br />Council Member Meehlhause did not object to any of the provisions. He believed that the 28 <br />suggestions to be good business practices while still allowing for the sale of tobacco. 29 <br /> 30 <br />Council Member Hull asked if other cities had similar Tobacco License requirements within City 31 <br />Code for surveillance systems and recordings. Assistant City Administrator Crane commented 32 <br />she would investigate this further and report back to the Council in August. 33 <br /> 34 <br />MOTION/SECOND: Mueller/Gunn.
