iimplementation program including the estimated cost for improvements which <br /> identifies the portions of the capital improvement plan which the Manager <br /> proposes to implement during the following year. The Manager shall provide, at <br /> no additional cost to the City, the labor necessary to complete one or more of such <br /> projects with estimated total labor hours not to exceed 400 hours. The Manager <br /> may agree to undertake additional improvements provided that such <br /> improvements and associated additional compensation are agreed to in writing <br /> prior to undertaking such improvements. <br /> 3. To hire and train the personnel necessary to successfully maintain and operate The <br /> Bridges. The Manager agrees to comply with all applicable federal, state and <br /> local laws,resolutions, ordinances,rules, regulations and executive orders <br /> pertaining to unlawful discrimination on account of race, color, creed, religion, <br /> national origin, sex, marital status, status with regard to public assistance, <br /> disability or age. If the City has reasonable evidence to believe that any employee <br /> at The Bridges is incompetent or has performed their employment duties in an <br /> objectionable manner,the City shall have the right to recommend to the Manager <br /> that the employee be disciplined or terminated. <br /> 4. To supervise, manage and operate the day to day operations of The Bridges <br /> including by not limited to the maintenance of the course, and its buildings and <br /> equipment. <br /> 5. The Manager shall make every effort to keep the golf course open for play at all <br /> • times. The closure of the golf course for the purpose of performing <br /> improvements, during severe weather or for any other purpose shall be at the <br /> discretion of the Manager whom shall be responsible for providing reasonable <br /> notice to the City. <br /> 6. The Manager agrees to develop and maintain systems to insure the proper <br /> maintenance of facilities and equipment. The City reserves the right to inspect the <br /> facilities and equipment at least quarterly to insure that it is being properly <br /> maintained. <br /> 7. The Manager shall perform the grounds maintenance on all greens, tees, fairways, <br /> roughs, driving range, club house lawn and all other turf area within the <br /> boundaries of the golf course property. Such maintenance shall be maintained at a <br /> level that equals or exceeds the maintenance standards as set forth in Exhibit B. <br /> The City reserves the right to reasonably modify the minimum maintenance <br /> standards in order to comply with any present or future laws and regulation. <br /> 8. The Manager shall maintain the golf course in accordance with all federal, state <br /> and local laws, regulations and ordinances governing the use of pesticides. All <br /> permits, licenses and certifications shall be obtained by the Manager. <br /> 9. To promote The Bridges. Advertising will be considered a separate line its =:• <br /> the budget. Any increase over the approved budget for advertising must be <br /> approved in writing by the City otherwise it will be considered an additional <br /> • personnel cost for purposes of calculating Incentive Pay. <br /> 10. The Manager agrees to maintain an average markup on merchandise sales of 85%. <br /> If the average markup on merchandise sales at the end of the year does not equal <br /> at least 85%,the difference will be considered an additional personnel cost for <br />
