• strictly in conformity with all federal, state, county, or city laws or ordinances. <br /> 17. The Manager shall at all times have in plain view in the clubhouse a price list or <br /> printed schedule of prices of all available commodities and services. All prices <br /> shall be competitively priced with establishments within the service area that have <br /> similar functions. <br /> 18. The Manager shall employ an adequate number of personnel to cover the <br /> operations and maintenance during the minimum hours of operation. <br /> 19. The Manager affirms that to the best of his knowledge,his involvement in this <br /> agreement does not result in a conflict of interest with any party or entity which <br /> may be affected by the terms of this agreement. The Manager agrees that, should <br /> any conflict or potential conflict of interest become known to the Manager,the <br /> Manager will immediately notify the City of the conflict or potential conflict, <br /> specifying the part of this agreement giving rise to the conflict or potential <br /> conflict, and will advise the City whether the Manager will or will not resign from <br /> the other engagement or representation. <br /> Article IV Rights of the Manager. <br /> 1. The Manager shall have the right to hire those individuals whom he feels will be <br /> best able to assist in effectively carrying out the duties enumerated under this <br /> contract, and to design and provide a compensation package for such individuals. <br /> The Manager shall also have the right to fire, discipline and otherwise direct the <br /> • employees of The Bridges. The Manager agrees to follow applicable federal and <br /> state laws in hiring, promoting,paying and terminating any and all employees <br /> employed at The Bridges. <br /> 2. The Manager shall have the right to establish base salaries, and incentive pay if <br /> applicable, for all other golf course personnel,provided that the total personnel <br /> costs for all golf course personnel do not exceed 44% of gross revenues in an <br /> average year. All proposed base salaries will be presented to the City during the <br /> budget process; if the City perceives that any proposed salaries will create <br /> problems with State Comparable Worth statutes or total personnel costs may <br /> exceed 44% of gross revenues at The Bridges,the Manager will adjust the <br /> proposed base salaries. <br /> 3. The Manager shall have the right to determine the day to day operating <br /> procedures to be used at the Bridges. <br /> 4. The Manager shall have the right to determine the hours of.operating for the <br /> Bridges and to set the fees and/or charges for lessons, services and other items not <br /> requiring approval by the City. <br /> 5. The Manager shall have the exclusive right to The Bridges clubhouse for purposes <br /> of operating the golf course. Nothing,however, precludes the City from using the <br /> clubhouse for City sponsored functions providing they do not conflict with other <br /> scheduled normal operations or events and providing the City provides adequate <br /> • notice and leaves the clubhouse in the same condition as it was. <br /> Article V.
