The City Council originally approved a wetland alteration permit for this <br /> property in Resolution No. 4852 on November 27, 1995. That permit, however, has expired. <br /> 0 According to Section 1010.08, Subd. 9 of the City Code, work must be completed within twelve <br /> months of the date of permit issuance or the permit shall become void. Prior to the permit's <br /> expiration, however, the applicant began preparation of the site by clearing vegetation and trees <br /> and by hauling in the necessary fill. <br /> Regulatory Background: <br /> The City reviews all development that occurs within wetlands and their buffers because of the <br /> important role that wetlands play in maintaining the ecosystem and the area hydrology, in that <br /> they are critical to the present and future health, safety and general welfare of the land, animals <br /> and people within the City. Any existing and potential development within the City and the Rice <br /> Creek Watershed pose increasing economic and ecologic demands, potentially despoiling, <br /> polluting or negatively altering wetlands and their contributory function and benefit to the City. <br /> According to Chapter 1010 of the Municipal Code relating to the Wetland Zoning District and the <br /> recently-adopted Ordinance No. 602 amending Chapter 1010, any work occurring within the 100- <br /> foot buffer surrounding a wetland or within a wetland itself requires either a wetland buffer or <br /> wetland alteration permit. In addition, approvals must be obtained from Rice Creek Watershed <br /> District, the local government regulatory agency overseeing wetlands and other hydrological <br /> features. <br /> Discussion: <br /> iThe scope of the proposed work involves the excavation and filling of wetland area in order to <br /> establish a building pad. As a result, the applicant is required to mitigate the loss of wetland by <br />
