It was noted by the Planning <br />Commission that variances were not <br />presidential. The Planning Commission <br />was concerned about the clause in the <br />resolution which stated that granting <br />the variance would not confer special <br />privileges on the applicant that are not <br />enjoyed by other property owners in the <br />same district, and asked that this <br />statement be removed from the... <br />resolution. They also requested that <br />the statement indicating that the <br />literal interpretation of the provisions <br />of this code would deprive the applicant <br />of rights commonly enjoyed by other <br />properties in the same district under <br />the terms of the code also be removed <br />from the resolution. <br />The Planning Commission was concerned <br />about the location of the proposed <br />driveway. Planner Harrington indicated <br />that the curb cut would be located 40 to <br />50 feet east of the present berm curb. <br />Planner Harrington reminded the Planning <br />Commission that this resolution would <br />require a 2/3 vote for its adoption. <br />5 ayes 1 nay <br />Ken Sjodin, representing Citywide <br />Developers, Inc., was present. <br />Planner Harrington reminded the Planning <br />Commission that this item was discussed <br />at their June 15th Agenda Session. <br />Planner Harrington informed the <br />Commission that he had contacted Short - <br />Elliott -Hendrickson, the City's <br />Consulting Engineers, regarding the <br />issue of storm water drainage. <br />Planner Harrington discussed the <br />contingencies noted in the proposed <br />Motion Carried <br />8.
