09-28-94 O2: 33PM FROM CITY OF MAPLE GROVE TO 7843462 P003/0O7 <br /> 220:05, Subd. 2(c)(2) <br /> (Rev. 1987) <br /> (A) Shall have been in existence in the City for at least one /- <br /> (1) year prior to the date of making application for such <br /> permit, or <br /> (8) Shall be a subsidiary located in the City of any such tax <br /> exempt organization of national or statewide jurisdiction <br /> that shall have been in existence for more than one (1) <br /> year. <br /> (2) Application for such a permit shall be received in the office <br /> of the Parks and Recreation Board sufficiently in advance so <br /> as to be processed and a permit issued in a timely manner prior <br /> to the event for which the permit is requested. The said permit <br /> may be issued administratively by the Board's staff if the <br /> requirements of Paragraph (1) above are fully met. <br /> (3) The Parks and Recreation Board, its staff, or both, may attach <br /> such conditions to the permit as deemed appropriate both for <br /> the health, safety and welfare of the permittee and the public <br /> and for the public's enjoyment of the location which the permit <br /> applies. <br /> (A) The permittee may appeal any such condition to the Parks <br /> and Recreation Board, in writing, by filing the appeal <br /> with the Director of Maple Grove Parks and Recreation <br /> within ten (10) days of the permit leaving the Parks and <br /> Recreation Board for the purpose of delivery to the <br /> permittee. <br /> (8) Said appeal shall be placed before the Parks and Recreation <br /> Board at its next regular meeting. <br /> (C) The Parks and Recreation Board shall hear all testimony <br /> and receive all evidence offered and deemed by said Board <br /> to be relevant. After considering all of the evidence and <br /> testimony submitted, the Parks and Recreation Board may <br /> order such action as it, in its sole discretion, deems <br /> appropriate. <br /> (D) Any use of such a permit during the appeal process and <br /> prior to the Parks and Recreation Board's decision shall <br /> constitute a waiver of any objection to the terms and <br /> conditions of the permit, which terms and conditions shall <br /> thereupon be strictly followed. <br />
