b. The display and display areas for adult use- <br /> accessory shall comply with Minnesota Statutes, <br /> Section 617.923 and any amendments thereto, and <br /> shall comply with all state and federal laws <br /> regarding the display and dissemination of harmful <br /> materials to minors. <br /> c. Adult use-accessory shall be prohibited from both <br /> internal and external advertising and signing of <br /> adult materials and products. <br /> d. Adult use-accessory shall be restricted from and <br /> prohibit access to minors by the physical <br /> separation of such items from areas of general <br /> public access: <br /> (i. ) Movie Rentals. Display areas shall be <br /> restricted from general view and shall be <br /> located within a separate room, the access of <br /> which is in clear view and under the control <br /> of the persons responsible for the operation. <br /> (ii. ) Magazines. Publication classified or <br /> qualifying as adult uses shall not be <br /> physically accessible to minors and shall be <br /> covered with a wrapper or other means to <br /> prevent display of any material other than the <br /> publication title. <br /> (iii. )Other Use. Adult uses-accessory not <br /> specifically cited shall comply with the <br /> intent of this section subject to the approval <br /> of the City Administrator or his/her designee. <br /> Subd. 12 INVESTIGATION FEES <br /> a. At the time of each original application for a license, <br /> the applicant shall pay a minimum investigative fee. <br /> This minimum fee shall be a five hundred dollars <br /> ($500.00) per person the application, and additional <br /> direct costs associated with the investigation will be <br /> billed to the applicants(s) . The minimum investigating <br /> fee shall not be subject to refund. If the expenses of <br /> the investigation relating to any application exceed the <br /> minimum investigation fee, the city shall notify the <br /> applicant(s) of this fact and shall require the <br /> applicant(s) to pay an additional investigating fee which <br /> the city administrator deems necessary to complete the <br /> City's investigation of the applicant(s) . The <br /> applicant(s) shall pay such an additional investigating <br /> fee within five (5) days of being so notified. If such <br /> additional investigating fee is not paid within such <br /> 16 <br />
