She also wondered what impact an ice <br /> 2 skating rink would have on the wetland, if one were constructed in <br /> 3 Woodcrest Park. <br /> 4 <br /> 5 Linke explained that Woodcrest Park is below the elevation of the <br /> 6 property being considered for this application, so there would be <br /> 7 no impact to the wetland. <br /> 8 <br /> 9 Councilmember Blanchard reported that she had received a phone call <br /> 10 from Ray Schelonka, 5139 Red Oak Drive, who was unable to attend <br /> 11 the meeting but expressed his concern about potential drainage <br /> 12 problems on the property. He is opposed to granting a Wetland <br /> 13 Alteration Permit. <br /> 14 <br /> 15 Ms. Hjelle, 5161 Red Oak Drive, asked when the property was rezoned <br /> 16 from R2 to Rl. Linke explained that it had not been rezoned. <br /> 17 There could be R1 housing built on an R2 lot. <br /> 18 <br /> 19 Trude asked if the proposed house could be built outside the Buffer <br /> 20 Zone. <br /> 21 <br /> 22 Harrington explained that a 30 foot wide sanitary sewer easement <br /> 23 was taken by the County a number of years ago, which renders the <br /> 24 southeast corner of the property not buildable. A structure is not <br /> 25 allowed on the easement. There simply is no other buildable site <br /> 26 on this lot. <br /> 27 <br /> 28 Trude asked if there was a situation in the city where an entire <br /> 29 new home, garage, and driveway were all constructed within a <br /> 30 Wetland Buffer Zone. Linke cited two examples. <br /> 31 <br /> 32 Harrington explained that the purpose of the Wetland Buffer Zone <br /> 33 was to give the City a certain amount of control close to the <br /> 34 wetlands for storm water management. City Code does have <br /> 35 provisions to allow for development within those Buffer Zones if it <br /> 36 will not have a negative impact on the wetland itself. <br /> 37 <br /> 38 Trude expressed concern that Councilmembers did not have adequate <br /> 39 time to review this issue, and said she would like to have the City <br /> 40 Consulting Engineer present for discussion. <br /> 41 <br /> 42 Blanchard felt that the concept of having a Buffer Zone would be <br /> 43 destroyed by allowing an entire home to be built within it. <br /> 44 <br /> 45 Linke said that by not allowing development on the only buildable <br /> 46 site of this property, it was basically a taking by the City. He <br /> 47 questioned what the City's liabilities would be in that case. He <br /> 48 added that the Buffer Zone was created ten years ago; prior to that <br /> 49 time this property could have been built on. <br /> 50 <br />
