c. The term "winter road maintenance" shall mean to <br /> keep the aforesaid portions of County roadways <br /> reasonably free and clear from ice, snow and <br /> debris, and undertake proper sanding and/or <br /> salting when necessary. It shall be the City's <br /> responsibility to maintain the through traffic <br /> lanes to their full width during the winter <br /> months. <br /> d. The City shall furnish all equipment, materials <br /> and staff necessary to provide routine and winter <br /> road maintenance. <br /> 2 . Payment: The County shall pay the City as follows: <br /> a. The County shall pay the City for actual expenses <br /> incurred maintaining said County roadways. This <br /> expense shall not exceed an amount based on the <br /> following: The unit cost of reimbursement shall <br /> be on a square yard road surface basis. The unit <br /> price will be based on square yard of pavement <br /> maintained by County forces. Area calculations <br /> identified in the Ramsey County Pavement <br /> Management Program will be the basis for <br /> determining total square yards maintained by each <br /> agency. <br /> FORMULA <br /> COUNTY SQ. YR. COST = TOTAL COUNTY COST FOR ROUTINE MAINT <br /> AND SNOW & ICE CONTROL/TOTAL SQ. YD. OF ROAD <br /> SURFACE <br /> CITY REIMBURSEMENT = COUNTY SQ. YARD. COST X CITY SQ. YD. <br /> MAINTAINED <br /> b. The County shall pay the City for these services <br /> on submission of a billing detailing expenses at <br /> the end of each year. <br /> c. On the effective date a County roadway is <br /> transferred to the jurisdiction of the City, the <br /> County shall no longer be responsible for the <br /> payment for routine and winter road maintenance. <br /> 3 . Relationship between the parties: <br /> a. The parties agree that the relationship between <br /> them created by this agreement is that of employer <br /> (the County) and independent contractor (the <br /> City) . No agent or employee of the City shall be <br /> deemed to be the agent or employee of the County. <br />
