UNAP , <br /> PROVED <br /> Mounds View City Council Page 11 <br /> Regular Meeting June 26, 1995 <br /> 1 Councilmember Trude questioned the status of the Silver Lake <br /> 2 Woods Fund which has been used for several years to cover the <br /> 3 cost of sealcoating and preventative maintenance. Mr. Ulrich <br /> 4 responded it is almost depleted <br /> 5 <br /> 6 Marlene Westphal, 8232 Greenwood Drive, advised she owns a <br /> 7 corner lot and believes they are being discriminated against <br /> 8 by having to pay an assessment on both lots. She reported <br /> 9 their request for locating an accessory building was refused <br /> 10 which makes her feel like the owners of corner lots do not <br /> 11 have the—right to-use th it property and make improvements, <br /> 12 are taxed at a higher rate and are asked to pay for two <br /> 13 streets. <br /> 14 <br /> 15 Mr. Ulrich reviewed how corner lots are proposed to be <br /> 16 assessed, advising Ms. Westphal would be assessed for 100% of <br /> 17 the adjusted front footage on Greenwood and 25% of the <br /> 18 adjusted front footage of Arden. <br /> 19 <br /> 20 Ms. Westphal restated her objection to being assessed twice <br /> 21 and asserted it is not a privilege to own a corner lot. <br /> 22 <br /> 23 Duane McCarty, 8060 Long Lake Road, pointed out he had raised <br /> 24 some questions at the last meeting and would have appreciated <br /> 25 a courtesy call and receiving staff's recommendations prior to <br /> 26 the meeting so he had time for review in detail. He asserted <br /> 27 the proposed action of the assessment policy will result in <br /> 28 circumventing resident's ability to have any meaningful input <br /> 29 on this issue. He stated he can not comment on the rest since <br /> 30 he did not receive a copy for review to determine if the <br /> 31 proposed policy is in full compliance with City Charter, as he <br /> 32 views it. <br /> 33 <br /> 34 Mr. McCarty commented the tenants of the Charter were included <br /> 35 because there are things residents want like a long-term <br /> 36 finance plan, long-term CIP, etc. He reviewed the history of <br /> 37 adoption of Chapter 202, the current assessment policy, and <br /> 38 expressed concern that it merges properly with proposed <br /> 39 Chapter 560. He advised he wants to be sure the Council <br /> 40 understands all the tenants of Chapter 202 and that it is not <br /> 41 being ignored or they are not aware of it. <br /> 42 <br /> 43 Mr. McCarty questioned how the Council intends to coordinate <br /> 44 proposed Chapter 560 with existing Chapter 202 . <br /> 45 <br /> 46 Mayor Linke explained he reviewed both chapters and determined <br /> 47 Chapter 202 is more broad where Chapter 560 contains actual <br /> 48 policy on how assessments would be developed as to percentage. <br /> 49 Chapter 560 also deals with lot shapes and gets down to <br /> 50 specifics and numbers where Chapter 202 does not.
