Also, <br /> 3 once the number is established, it will be set for all streets <br /> 4 across-the-board and not depend on who is serving on the <br /> 5 Council. <br /> 6 <br /> 7 Mr. McCarty questioned procedure if the project does not <br /> 8 provide a 66% increase in value, which is why this aspect is <br /> 9 not included in Chapter 202 . He advised they wanted Chapter <br /> 10 202 to provide flexibility since it is almost impossible to <br /> 11 predict—what the actual increase in value will be. Also, it <br /> 12 allowed the Council to "tailor make" each assessment hearing <br /> 13 to fit the project. Mr. McCarty stated he disagrees with <br /> 14 comments made about the generalness of Chapter 202 . He <br /> 15 believed it was very extensive and covered some bases not <br /> 16 covered in Chapter 560. <br /> 17 <br /> 18 Mayor Linke reviewed the appeals procedure section and advised <br /> 19 it is addressed in Chapter 560. <br /> 20 <br /> 21 Councilmember Hankner suggested rather than trying to debate <br /> 22 all the issues tonight, that Mr. McCarty be allowed to do the <br /> 23 requested analysis and make suggestions on areas of Chapter <br /> 24 560 that may not merge with Chapter 202 . She advised she is <br /> 25 not prepared to act on this matter tonight and prefers more <br /> 26 time to review recommendations of the staff and attorney. <br /> 27 <br /> 28 Mr. McCarty stated while he appreciates the good faith <br /> 29 Councilmember Hankner has in his ability, he believes this is <br /> 30 the Council's business. He asserted it is important for every <br /> 31 Councilmember and top staff members to understand what <br /> 32 existing Chapter 202 does. He stated it is clear to him that <br /> 33 they have not had the opportunity to make an in-depth study. <br /> 34 <br /> 35 Councilmember Hankner explained that they have reviewed the <br /> 36 chapters but there may be a difference of opinion and she <br /> 37 would like Mr. McCarty to present real specifics for Council's <br /> 38 consideration. <br /> 39 <br /> 40 Councilmember Trude advised Mr. Thompson has assured the <br /> 41 Council that Chapters 202 and 560 dovetail together. She <br /> 42 concurred Chapter 202 is very general and Chapter 560 is more <br /> 43 specific on how to do projects and indicates what those <br /> 44 procedures are as specified by City Charter. <br /> 45 <br /> 46 Councilmember Trude informed she is not totally comfortable <br /> 47 with the 66% and noted some communities have residents look at <br /> 48 this type of policy and provide their recommendations which <br /> 49 may include partial or combination financing. <br /> 50 <br />
