Resolution 7673, Authorizing Braun Intertec Corporation to perform 3 <br />Preliminary Geotechnical and Environmental Evaluation for the Design 4 <br />Phase for Area D of the Street and Utility Improvement Program. 5 <br /> 6 <br />Public Works Director DeBar explained Bonestroo was hired to design the street utility plans for 7 <br />Area D. Staff solicited three companies to provide services for the geotechnical and 8 <br />environmental evaluations for this phase of the project. Staff recommended Braun Intertec 9 <br />Corporation for this work at an expense of $5,005. He explained the City has worked with Braun 10 <br />Intertec for Areas B/C. 11 <br /> 12 <br />Council Member Mueller questioned if the City had any additional site mobilization expenses 13 <br />from last year’s project. Public Works Director DeBar indicated he was uncertain of this but felt 14 <br />the estimated expense was in line with the amount of testing that was required for Area D. 15 <br /> 16 <br />MOTION/SECOND: Mueller/Hull. First Reading and Introduction of Ordinance 851, an Ordinance Amending 23 <br />Chapters 502 and 503 of the City Code Regarding Liquor Sales on Sundays. 24 <br /> 25 <br />City Administrator Ericson indicated the City Council adopted Ordinance 843 earlier this year on 26 <br />May 10, 2010. The ordinance made numerous changes to both Chapter 502 and 503 regulating 27 <br />liquor sales in the City of Mounds View. One of the changes in Ordinance 843 addressed liquor 28 <br />sales on Sundays. The City Council deleted reference to an additional license that could be 29 <br />obtained by establishments to provide for sales of alcohol from 10:00 am to noon on Sundays. It 30 <br />was staff’s understanding that no licensed entity served alcohol during this time, since no 31 <br />establishment had ever requested the additional license. 32 <br /> 33 <br />City Administrator Ericson stated it has since come to our attention that both Mermaid and 34 <br />Moe’s have a history of serving alcohol on Sundays before noon, usually in conjunction with a 35 <br />brunch or some other food service. Neither owner was aware that a separate license in addition 36 <br />to the Sunday license was needed to serve for the two hours before noon on Sundays. (The State 37 <br />of MN allows for the sale and service of alcohol beginning at 10 am Sundays.) While the 38 <br />original language, now deleted, seemed fairly straightforward, clearly it had been interpreted 39 <br />otherwise by two of our licensed establishments. Based on direction provided by the City 40 <br />Council at their work session on September 7, 2010, the attached ordinance is available for 41 <br />introduction and first reading.
