Mounds View City Council September 13, 2010 <br />Regular Meeting Page 10 <br /> <br /> 1 <br />City Administrator Ericson noted John Winiecki at 7575 Groveland Road has expressed concern 2 <br />with the workmanship on his driveway apron. The slab has pitted and was inspected by 3 <br />Bonestroo. The apron was found to be inferior and was recommended for replacement. The City 4 <br />promised this property owner an apron and this has not yet been completed. The approximate 5 <br />cost for the apron would be $1,200. He asked if staff could proceed utilizing funds from the 6 <br />street improvement fund to replace the driveway apron. 7 <br /> 8 <br />Council Member Stigney questioned if the Street and Utility Committee had reviewed this issue. 9 <br />City Administrator Ericson indicated they had not reviewed the driveway apron request. 10 <br /> 11 <br />Council Member Stigney asked if the contractor has been contacted regarding the poor 12 <br />workmanship. City Administrator Ericson stated the apron has been replaced once by the 13 <br />contractor and was still in poor condition. He was uncertain why the contractor was not 14 <br />contacted sooner. Public Works Director DeBar indicated the apron had a two-year warranty. 15 <br /> 16 <br />Council Member Stigney requested staff speak with the contractor and request a new apron. City 17 <br />Administrator Ericson stated he would be willing to contact the contractor to request it be 18 <br />replaced. 19 <br /> 20 <br />Mayor Flaherty agreed with this suggestion. 21 <br /> 22 <br />Council Member Gunn did not want to see the homeowner have to wait too much longer for the 23 <br />apron replacement. 24 <br /> 25 <br />Council Member Hull suggested the contractor be contacted and he was not willing to replace the 26 <br />apron that street improvement funds be used to complete the work yet this fall. 27 <br /> 28 <br />Council Member Mueller asked if the contractor would compensate the City for the expense of 29 <br />the project to allow another contractor to complete the project more efficiently. The City has an 30 <br />obligation to complete this apron and a contractor was in the area, and felt the work should be 31 <br />completed yet this fall. 32 <br /> 33 <br />Mayor Flaherty requested that this issue be brought to the attention of the Street Utility 34 <br />Committee. 35 <br /> 36 <br />City Administrator Ericson reported staff held an arbitration session with LELS on August 13th. 37 <br />The arbitrator’s ruling was due back to the City today. The ruling would be brought to Council 38 <br />once received. 39 <br /> 40 <br />Council Member Mueller questioned if the negotiations would presumed to be retroactive. City 41 <br />Administrator Ericson stated this would not be presumed, especially when 11 months into the 42 <br />year. 43 <br /> 44
