Mounds View City Council October 11, 2010 <br />Regular Meeting Page 7 <br /> <br />the sign code. Council was supportive of all the suggestions proposed by City Staff, and directed 1 <br />staff to draft an ordinance making the changes. There also are changes for campaign signs in this 2 <br />ordinance due to the date change of the state primary. On Monday, September 27, 2010, the City 3 <br />Council approved the introduction and first reading of Ordinance 847 that makes several changes 4 <br />to Chapter 1008 about signs, including campaign signs in order to ensure the City Code is 5 <br />consistent with State law. The Council preferred that the non-commercial opinion sign size be 6 <br />limited to six square feet in R-1, R-2 and R-3 zoning districts, and staff has made that change to 7 <br />the ordinance. Staff recommends approval of the second reading and adoption of Ordinance 847. 8 <br /> 9 <br />MOTION/SECOND: Gunn/Mueller. To Waive the Second Reading and Adopt Ordinance 847, 10 <br />Amending Chapter 1008 of the Mounds View City Code about Signage with the revised 11 <br />language and publish a summary of the Ordinance as authorized by City Charter. 12 <br /> 13 <br />ROLL CALL: Hull/Stigney/Mueller/Gunn/Flaherty. 14 <br /> 15 <br /> Ayes – 5 Nays – 0 Motion carried. 16 <br /> 17 <br />F. Resolution 7677, Reapproving the Select Senior Living Final Plat, 18 <br />Development Agreement, Conditional Use Permit and Development Review. 19 <br /> 20 <br />Community Development Director Roberts stated on October 27, 2008, the City Council passed 21 <br />Resolution 7347, which approved the final plat and development agreement for the Select Senior 22 <br />Living development. This was the last of the Council actions required in order for the project to 23 <br />move forward. Per City Code, an applicant has 120 days to record the plat with Ramsey County, 24 <br />and if the recording does not happen within this timeframe, the plat approval is void. The code 25 <br />also states that the plat can be reapproved and the applicant given up to another 120 days. Due to 26 <br />the shakeup within the banking industry, Select Senior Living was not able to start the project 27 <br />within 120 days of City approval and their final plat and development agreement approval 28 <br />became void. 29 <br /> 30 <br />Community Development Director Roberts indicated Select Senior Living, represented by Joel 31 <br />Larson, has submitted a letter requesting that the City re-approve their planning requests once 32 <br />again. Mr. Larson is asking for a 120-day re-approval of the final plat and development 33 <br />agreement. These would then expire on February 9, 2011. Also approved by the City Council in 34 <br />October 2008 for this project was a conditional use permit and the development review. The 35 <br />conditional use permit approval also expired due to non-use within one year. Select Senior 36 <br />Living also is asking for re-approval of their conditional use permit to allow senior housing in a 37 <br />R-4, high density residential district. Staff suggests that the Council also re-approve the 38 <br />development review to help ensure there is a clear and consistent record of City approvals for this 39 <br />project. The Planning Commission re-approved the variances for this project on Wednesday, 40 <br />October 6, 2010. Staff recommends that the City Council pass the Resolution. 41 <br /> 42 <br />MOTION/SECOND: Gunn/Mueller. To Waive the Reading and Adopt Resolution 7677, 43 <br />Reapproving the Select Senior Living Final Plat, Development Agreement, Conditional Use 44 <br />Permit and Development Review. 45
