Second Reading and Adoption of Ordinance 852, an Ordinance Amending 4 <br />Chapter 1002 of the Mounds View City Code about Recreational Fire 5 <br />Regulations. 6 <br /> 7 <br />City Administrator Ericson stated that at the August 2, 2010 and September 7, 2010 work 8 <br />sessions, the City Council discussed issues regarding recreational fires and the impacts of such 9 <br />fires on neighboring property owners. The Spring Lake Park – Blaine – Mounds View Fire 10 <br />Department regulations were reviewed as were policies and regulations from many other cities. 11 <br />One of the primary concerns expressed by residents relates to enforcement. The secondary issue 12 <br />is the impact of one neighbor’s recreational fire upon another neighbor. City Administrator 13 <br />Ericson reviewed the changes from the present Fire Department regulations contemplated by 14 <br />Ordinance 852 as the following: 15 <br /> 16 <br />• Wind speed restrictions (no rec fires when winds exceed 10 mph) 17 <br />• No recreational fire within 15 feet of a property line 18 <br />• Manufactured fire pits shall be set back a minimum 15 feet from combustible 19 <br />materials or structures 20 <br />• Recreational fires prohibited when burning ban or air advisory in effect 21 <br /> 22 <br />City Administrator Ericson explained in response to concerns raised by both Mounds View and 23 <br />the City of Blaine, the Fire Department has updated its regulations pertaining to recreational 24 <br />fires. There are two differences, the first being the height of the fire. Ordinance 852 limits the 25 <br />height of a fire to no more than two feet while the Fire Department regulation allows for fires up 26 <br />to three feet. The other difference is with the setback of freestanding manufactured fire pits. 27 <br />Ordinance 852 requires a minimum fifteen foot setback while the Fire Department regulations 28 <br />allow for a ten foot setback; however the Fire Department regulation requires that such devices 29 <br />be equipped with side screens and a cover. Fire Chief Zikmund is aware of the differences. Staff 30 <br />recommends approval of the Ordinance. 31 <br /> 32 <br />MOTION/SECOND: Mueller/Hull. To Waive the Second Reading and Adopt Ordinance 852, 33 <br />an Ordinance Amending Chapter 1002 of the Mounds View City Code about Recreational Fire 34 <br />Regulations and to publish a summary of the Ordinance as authorized by City Charter. 35 <br /> 36 <br />Council Member Mueller thanked the residents that brought forward their concerns and for 37 <br />working with the Council regarding recreational fires. 38 <br /> 39 <br />Mayor Flaherty agreed. 40 <br /> 41 <br />ROLL CALL: Hull/Stigney/Mueller/Gunn/Flaherty. 42 <br /> 43 <br /> Ayes – 5 Nays – 0 Motion carried. 44
