in that the contractor cannot proceed in the sequence which is optimum for <br /> completion of the course. We conveyed to the MWCC representatives that our <br /> construction schedule has not changed, but theirs had and that change negatively <br /> impacted our course. Our schedule dictates that the seeding must occur no later than <br /> August 31st. Any delays in that timeline will delay the opening beyond the anticipated <br /> July 4 weekend and reduce anticipated season revenues. Consequently, the MWCC <br /> must complete their work on our site no later than July 31st. <br /> The result of the meeting was an agreement of MWCC to meet with their principle <br /> parties and discuss alternatives to their current construction schedule. We have <br /> scheduled another meeting for next Tuesday, 9:00 a.m. at City Hall. <br /> Andover Landfill <br /> The Governor signed the bill which created a State funding mechanism to clean up <br /> the already identified closed landfills in Minnesota. This is very good news for the City <br /> for two reasons: (1) it means that the WDE group has another recourse to clean up <br /> the Andover site and will not initiate a third party lawsuit against the City; and (2) <br /> there is a provision in the law which provides for reimbursement for past payments for <br /> landfill clean up. The City more than likely will be reimbursed for the money already <br /> contributed to the Oak Grove Trust. <br /> I have included in this issue of This Is It a copy of the letter from the law firm <br /> representing the WDE Andover group. I expect to hear from them prior to the June <br /> 6th Work Session and will present additional information at that time regarding the <br /> group's decision to participate or not participate in the state program. <br /> Ethics Law <br /> One of the results of the 1994 Legislative Session was the passage of the Ethics Law <br /> and the extension of its restrictions to all public employees. Effective August 1, 1994, <br /> it will be a gross misdemeanor for any public employee/official to accept any gift from <br /> any individual, company or institutional entity that in any way has business with the <br /> employee's governmental group. That gift could be as incidental as a cup of coffee. I <br /> have asked the LMC staff to provide us with an opinion as to the City's position <br /> regarding donations of items for the Community Appreciation Dinner. <br /> Samantha <br /> Economic Development <br /> Attraction Requests: <br /> I received three requests this week for companies interested in retail and commercial <br /> space. The first two requests came to the City from the Metro East Development <br /> Partnership and the third from Everest Development. <br />
