9. 3 ACRES <br /> NORTHEAST CORNER OF EDGEWOOD DRIVE & HIGHWAY 10 <br /> MOUNDS VIEW <br /> THE FOLLOWING IS A PARTIAL HISTORY OF THE PROPERTY: <br /> 1940 & 1958 - Aerial photographs, which are used extensively <br /> in determining and monitoring wetlands, show a small ditch <br /> running through the property, not a wetland. <br /> (see documents # 3 & 4, & per government aerial photo expert) <br /> 1958 - The owner requested rezoning to B-3 to accommodate a <br /> planned shopping center, citing the need for shopping <br /> facilities in Mounds View. This was a reasonable request, <br /> not spot zoning or something that would not have been <br /> anticipated on a State highway. The City rejected his <br /> request, citing lack of a thoroughfare, the existence of <br /> other sites more favorable to shopping center development, <br /> and potential devaluation of nearby residential property. <br /> (see documents # 5, 6 & 7) <br /> 1960 or 1961 - City extended Edgewood Drive through to <br /> Highway 10, as gravel road, changing it from a cul de sac to <br /> a through street. City government complex was begun. <br /> 1964 - Without request from the owner, the City changed the <br /> zoning to B-3 . (per City records) <br /> 1964 - City installed storm sewer in Edgewood Drive. (see <br /> documents # 8 thru 8.o, 11 & 14) <br /> 1964, 1965 & 1966 - The owner gave the City various use and <br /> access easements ($1.00 apiece) for storm sewer projects on <br /> this and other property in Mounds View, in return for <br /> assurance of continued storm water drainage from this <br /> property. (see documents # 8 - 8.o) <br /> 1965 - Survey shows elevation of storm sewer catch basin <br /> providing drainage for the property. (see document # 14) <br /> 1965 - City Council at Public Hearing voted to vacate <br /> Edgewood Drive cul de sac as well as ditch and drainage <br /> easements over the property, and agreed to provide drainage <br /> for property with existing storm sewer. Ramsey District <br /> Court affirmed the above vacations and agreements. (see <br /> documents # 9, 10, 11 &12) <br /> 1965 & 1966 - Milner W. Carley & Associates, former Village <br /> Engineers for Mounds View, designed a retail/motel/restaurant <br /> facility for the property, with no indication of wetland area <br /> on the site, and no need for ponding on the site. <br /> (see documents # 15, 16 & 17 & 20) <br /> -1- <br />
