1967 - City finished Edgewood Drive over the property (without <br /> obtaining right of way, to this day) , making it a paved <br /> through-street. While finishing Edgewood, the City changed <br /> the storm sewer drainage outlet and cut off all drainage for <br /> the property. (documents # 14, 18 & 19 & actual measurement) <br /> 1968 - The City notified the owner that, if he didn't obtain <br /> a building permit within 90 days, the property would revert <br /> back to R-1 zoning. (see document # 20) <br /> 1972 - The City conducted a vigorous campaign to attract <br /> commercial development to the site, advertising a <br /> comprehensive plan showing the property guided for business <br /> or shopping center, and highlighting the property as <br /> undeveloped. It asked for the owner's help in this effort. <br /> (see documents # 21 thru 27) <br /> 1975 & 1976 - City's Comprehensive Plan changed the owner's <br /> property to Medium and High Density Housing while changing <br /> the parcel behind it (away from Highway 10) to Highway <br /> Commercial, which made no sense. (see documents # 29 thru 37) <br /> 1976 - The owner granted the City's request to use the <br /> property for its Bicentennial recreational activities. <br /> (see document # 33) <br /> 1982 - Over the owners objections, the City designated more <br /> than twice the amount, that Rice Creek Watershed District <br /> required, as wetland, and imposed substantial additional <br /> restrictions, including 100 foot setbacks from the wetland, <br /> virtually eliminating any possibility of development. (see <br /> documents # 38 & 39) <br /> 1982 - The owner proposed a liquor store and cheese shop for <br /> the site. The City staff strongly discouraged this, giving <br /> an extensive list of possible obstacles (real and imagined) , <br /> saying for example (1) that although the zoning allowed a <br /> dairy store, the City didn't think that a cheese shop would <br /> qualify, and (2) that the City would soon be considering <br /> changes to the zoning, insinuating that the comprehensive <br /> plan and possible future changes, rather than the existing <br /> zoning, controlled the use of the property. Also given to <br /> the owner was yet another change to the Comprehensive Land <br /> Use Plan. The tenants backed out of the agreements to lease <br /> the property. (see documents # 40 thru 43) <br /> 1983 - City drainage project for St. Stephens Street, planned <br /> to drain into subject property as solution. <br /> (see document # 44) <br /> 1983 - Owner met with City regarding St Stephens Street <br /> drainage onto his property.
