1983 - City changed ordinance for property at County Road J & <br /> 85th Ave, at owner John Miller's request, reducing wetland <br /> designation. (see document # 46) <br /> 1985 - Aerial photograph shows change in character of subject <br /> property. (see document # 47) <br /> 1986 - The owner had a short term opportunity to have clean <br /> fill brought to the site at a nominal cost of twenty cents <br /> per cubic yard (typical rates today are $5. 00 per yard) . He <br /> approached the City for permission and was told by the <br /> Director of Public Works/Community Development that he (the <br /> Director) would propose it to the City and give it his total <br /> support. To the owner's misfortune, no such support for the <br /> permit was given. To the contrary, the Director did not <br /> recommend it and, instead, the owner was given a list of <br /> requirements so extensive it would have taken months to <br /> fulfill. Among them were requirements to get plan approval <br /> for and then install the storm sewer inlet that the City had <br /> wrongfully eliminated previously, a bonded development <br /> agreement, a revised wetland and flood plain map, the <br /> granting of easements to the City that the City had <br /> previously neglected to get for building Edgewood Drive and <br /> storm sewers, and a second hearing before the City Council. <br /> On top of the 12 requirements, at the last minute, the owner <br /> was informed that he would have to agree to remove the fill <br /> at any time the City might later request it. No permit was <br /> issued and the City kept the owner's $405. 00 permit fee. The <br /> supplier couldn't wait any longer and it turned out to be <br /> just another expensive lost opportunity for the owner. <br /> (see documents # 48 thru 52) <br /> 1988 & 1989 - The Ramsey County Assessor tried to assess the <br /> property at $261, 000 (1988) and $406, 100 (1989) but when the <br /> owner pointed out the wetland condition and classification, <br /> along with the restrictions, the valuations were changed to <br /> $75,800 and $132,700 respectively. <br /> (see documents # 53 thru 64) <br /> 1989 - City announced another plan to use subject property to <br /> solve its drainage problems. (see document # 65) <br /> 1992 - Mounds View, without prior notice, began billing the <br /> owner at the rate of over $600 per year for lighting. The <br /> owner can only wonder why he needs to provide lighting for a <br /> wetland, what benefit this expense affords him, and what will <br /> be next. (see document # 66) <br /> 1992 - City gave Harstad variance. City officials said "He <br /> bought the property years ago prior to the City's adoption of <br /> a wetlands ordinance in 1982. He didn't create the buffer. <br /> The City did. What we're talking about is a line on a <br /> drawing that we made. " (see document # 67) <br /> -3- <br />
