City changed wetland for owner John Forsberg. City official <br /> said "The wetland was originally decided by a contour line on <br /> a map. More or less, it was an arbritrary decision. " <br /> (see document # 67a. ) <br /> 1992 - We recently discovered that, contrary to construction <br /> plans on file at the City, actual measurement of the catch <br /> basin that was supposed to provide drainage for th property <br /> shows it to be two (2) feet above what it was originally, and <br /> what it is supposed to be now. (see documents # 14, 18, 19) <br /> • <br /> The City, over the years, has alternately discouraged, then <br /> encouraged, private development or improvement of the <br /> property. (see documents # 6, 16, 17, 20, 21 thru 27, 38 thru <br /> 43 & 48 thru 52) <br /> Records indicate that Mounds View has long-standing extensive <br /> and specific plans for the use of the property for its <br /> drainage system and possibly for its parks and recreation. <br /> The City has repeatedly refused, for ever-changing reasons, <br /> to allow development or improvement this property, dating <br /> back to 1958) . <br /> (see documents # 6, 30, 31, 32, 33, 37, 44, 65 & 68 thru 84) <br /> The property is now designated "wetland" with restrictions on <br /> development and usage, which has severely affected the <br /> saleability. At the same time the value and potential use of <br /> the property to the owner have been reduced, the benefits and <br /> potential use to the City have been increased. (see document <br /> # 1, City's Wetland Ordinance, and previous paragraph) <br /> In summary, the City has created a wetland on, wrongly designated <br /> as wetland, wrongly placed restrictions on, discouraged the <br /> development of, and has made plans for the use of, the owner's <br /> property. It has successfully prevented private use of the <br /> property, and made it useful only to the City. <br /> State and federal laws do not allow wetland designation on <br /> private property to increase public use thereof, nor do they <br /> allow public "taking" of private property without just <br /> compensation, yet Mounds View has done both. <br /> The owner would like the City to buy the property. <br /> -4- <br />
