November 24, 2008 Item No. 7H <br />Page 5 <br />Rice Creek Watershed District Permit <br />No impact to the Rice Creek Watershed District Permit is anticipated due to the drainage <br />analysis. The proposed analysis would be focused solely on storm water quantity and <br />rate control. Since there is no net increase in impervious surfacing due to the 2009-2010 <br />SUIP, the water quantity and rate control portions of the RCWD rules do not apply to the <br />project. The permit from RCWD is concerned with water quality and infiltration components <br />only. Therefore, even if the analysis does result in a change to the storm sewer <br />improvements in the 2009-2010 SUIP, it should not affect the permit from RCWD. <br />Conclusion <br />The existing 1989 Study of the Ardan Avenue Drainage Subdistrict that the City has on file <br />recommends that a new trunk storm sewer and storm water detention pond be built along <br />Sherwood Road. Therefore at this point the City has essentially two choices: follow the <br />recommendation of the 1989 Study, or not follow the recommendation of the 1989 Study. <br />If the City chooses not to follow the recommendation of the 1989 Study, it should have a <br />basis for that decision. A new analysis of the Drainage Subdistrict, from a different <br />perspective than the 1989 Study, would form the basis for the decision on this issue. It <br />would hopefully identify an alternate approach that is less expensive and more practical, <br />yet still increases the effectiveness of the system and maintains or improves the current <br />level of flood protection. <br />Recommendation: <br />Resolution 7361 has been prepared to authorize Bonestroo to proceed with the analysis <br />based on their proposal. The Resolution is attached to this Staff Report for consideration <br />by the City Council. Staff recommends that the City Council adopt Resolution 7361, <br />authorizing analysis of the Ardan Avenue Drainage Subdistrict. <br />Respectfully submitted, <br />Joseph R.
