Item Description: Continuation of Public Hearing Regarding Potential Revocation of Conditional Use Permit, 3030 County Road J, Planning Case No. 304-90 Administrator's Review/Recommendation: - No comments to supplement this report - Comments attached. Explanation/Summary (attach supplement shee xr as necessary.) SUMMARY; As directed by the City Council, Staff has contacted the payees of canceled checks supplied the owner of 3030 County Road J in an effort to establish what goods or services were rendered. As you will recall, the property owner contends that an accessory structure on his property was built prior to zoning changes which would subject it to Conditional Use Permit requirements. In support of that contention, the owner provided Staff with the aforementioned canceled checks. Although most of the contacts acknowledged that purchases were made for materials, they were unable to give specifics as to what those materials were used for. In addition to following up on the canceled checks, Council directed Staff to have the City Attorney contact the legal representative of the property owner requesting written affidavits from construction workers or neighbors who can verify that the structure was erected .prior to the zoning change. The City Attorney has informed Staff that, following some minor delays, he has been in contact with the property owners attorney and the affidavits are forthcoming.
