Mounds View City Council April 9, 2007 <br />Regular Meeting Page 4 <br /> <br />MOTION/SECOND: Flaherty/Hull. To Waive the Reading and Adopt Ordinance 787 1 <br />Approving an Amendment to Chapter 1102 of the Mounds View Zoning Code to Define Health 2 <br />and Beauty Services. 3 <br /> 4 <br />Mayor Marty noted that the reason for this was that the aromatherapy license being applied for 5 <br />was not defined by Code. He then said that he finds no grounds to deny this but, he is not 6 <br />entirely comfortable with it. 7 <br /> 8 <br />ROLL CALL: Stigney/Marty/Mueller/Flaherty/Hull 9 <br /> 10 <br /> Ayes – 5 Nays – 0 Motion carried. 11 <br /> 12 <br /> C. Public Hearing to Consider the Introduction and First Reading of Ordinance 13 <br /> 788, an Amendment to the Mounds View Zoning Code: Amend Chapter 1102 14 <br /> to Define a Neighborhood Motor Fuel Station and Amend Chapter 1113 to 15 <br /> Allow a Neighborhood Motor Fuel Station as a Conditional Use in a B2 16 <br /> District 17 <br /> 18 <br />Planner Heller provided an overview of the proposed amendment to the Zoning Code to define a 19 <br />neighborhood motor fuel station. She then said that the Planning Commission was concerned 20 <br />about changing the Comprehensive Plan for the location so the recommendation was to ask Staff 21 <br />to make this work for The Station without requiring a zoning and comp plan change. 22 <br /> 23 <br />Planner Heller noted that the Planning Commission recommends approval of the proposed Code 24 <br />amendment. 25 <br /> 26 <br />Mayor Marty opened the public hearing. 27 <br /> 28 <br />Hearing no public comments, Mayor Marty closed the public hearing. 29 <br /> 30 <br />Council Member Mueller asked what would happen with the Conditional Use Permit if the 31 <br />owners wished to sell the station. 32 <br /> 33 <br />Planner Heller indicated that it would go with the property. 34 <br /> 35 <br />Council Member Mueller asked when The Station was originally established. 36 <br /> 37 <br />Planner Heller said it has been there for approximately 48 years. 38 <br /> 39 <br />Council Member Mueller asked if there is supposed to be some kind of space between the 40 <br />property lines. 41 <br /> 42 <br />Director Ericson responded that the adjoining Fedor Market building is non-conforming as it was 43 <br />constructed up to the property line 44 <br /> 45
