Item No. 8H <br />Meeting Date: November 13, 2006 <br />Type of Business: CA <br />WK: Work Session; PH: Public Hearing; <br />CA: Consent Agenda; CB: Council Business <br />City Administrator Review _______ <br /> City of Mounds View Staff Report <br />To: Honorable Mayor and City Council <br />From: Greg Lee, Director of Public Works <br /> <br />Item Title/Subject: Resolution 6959 Setting a Public Improvement <br />Hearing Date for the 2007 - 2008 Street and Utility <br />Improvement Project <br /> <br />Background: <br />On May 22, 2006 the City Council approved Resolution 6823 authorizing the <br />preparation of a preliminary feasibility report and the selection of a consultant for <br />the 2007-2008 Street and Utility Improvement Project. <br /> <br />On November 6, 2006, a draft Preliminary Feasibility Report for the 2007-2008 <br />Street and Utility Improvement Project was submitted for the City Council’s <br />review. <br /> <br /> <br />Discussion: <br />Set Public Improvement Hearing – As per State Statute 429.031: “Before the <br />municipality awards a contract for an improvement or orders it made by day <br />labor, or before the municipality may assess any portion of the cost of an <br />improvement to be made under a cooperative agreement with the state or <br />another political subdivision for sharing the cost of making the improvement, the <br />council shall hold a public hearing on the proposed improvement following two <br />publications in the newspaper of a notice stating the time and place of the <br />hearing, the general nature of the improvement, the estimated cost, and the area <br />proposed to be assessed.” <br /> <br />Staff is recommending that a public hearing be conducted to be in compliance <br />with this state statute and to allow the public to learn about the proposed project <br />and to provide comments. <br /> <br />A hearing date of December 11, 2006 will afford the necessary time to publish <br />legal notices. It is also anticipated that the final Feasibility Report will be <br />presented to the City Council on December 11, 2006 for consideration of <br />approval. <br />
