Item No. 8H Meeting Date: November 13, 2006 Type of Business: CA WK: Work Session; PH: Public Hearing; CA: Consent Agenda; CB: Council Business City Administrator Review _______ City of Mounds View Staff Report To: Honorable Mayor and City Council From: Greg Lee, Director of Public Works Item Title/Subject: Resolution 6959 Setting a Public Improvement Hearing Date for the 2007 - 2008 Street and Utility Improvement Project Background: On May 22, 2006 the City Council approved Resolution 6823 authorizing the preparation of a preliminary feasibility report and the selection of a consultant for the 2007-2008 Street and Utility Improvement Project. On November 6, 2006, a draft Preliminary Feasibility Report for the 2007-2008 Street and Utility Improvement Project was submitted for the City Council’s review. Discussion: Set Public Improvement Hearing – As per State Statute 429.031: “Before the municipality awards a contract for an improvement or orders it made by day labor, or before the municipality may assess any portion of the cost of an improvement to be made under a cooperative agreement with the state or another political subdivision for sharing the cost of making the improvement, the council shall hold a public hearing on the proposed improvement following two publications in the newspaper of a notice stating the time and place of the hearing, the general nature of the improvement, the estimated cost, and the area proposed to be assessed.” Staff is recommending that a public hearing be conducted to be in compliance with this state statute and to allow the public to learn about the proposed project and to provide comments. A hearing date of December 11, 2006 will afford the necessary time to publish legal notices. It is also anticipated that the final Feasibility Report will be presented to the City Council on December 11, 2006 for consideration of approval.
