6 .26 <br /> (7) "Bank" sick leave. Employees who have accumulated <br /> the maximum 120 days sick leave shall be permitted to accrue <br /> additional "bank" sick leave at the rate of one day per month. <br /> "Bank" sick leave shall not be used in computing severance pay. <br /> Subdivision 4 . Sick Leave Advance. Upon making written <br /> application to the Clerk-Administrator, regular full-time employees <br /> may be advanced sick leave . by the Council with the following <br /> conditions: <br /> ( 1) Employees with less than one year of service shall <br /> not be eligible. <br /> (2) Employees shall have exhausted all sick leave and <br /> vacation time in excess of 5 days available to them before <br /> receiving an advance of sick leave. <br /> (3) Eligible employees may receive advances of sick <br /> leave not to exceed 15 working days . <br /> (4) Whenever possible, as determined by the Council an <br /> employee who receives an advance of sick leave shall maintain an <br /> accrual of unused vacation leave equivalent to the outstanding <br /> balance of the advance. • <br /> (5) Any employee who receives an advance of sick leave <br /> shall repay that advance with sick leave the employee accrues for <br /> each month of service. <br /> (6) Any employee, whose employment with the City <br /> terminates prior to full repayment of the sick leave advance, shall <br /> repay said advance from his regular earnings . This shall be <br /> deducted from the employee's paycheck. <br /> 6 .27 . EMERGENCY LEAVE OF ABSENCE. In cases of serious <br /> emergency, including death or serious illness in the employee's <br /> immediate family or other emergency of a serious nature, a regular <br /> employee's Department Head may authorize use of sick leave benefits <br /> for such absences up to a maximum of three days for each emergency. <br /> 6 .28 MILITARY LEAVE OF ABSENCE. <br /> Subdivision 1. Military leave of absence and re-employ- <br /> ment of employees returning from active service with the Armed <br /> Forces shall be subject to applicable federal and state <br /> legislation. <br /> Subdivision 2 . Upon return from a military leave of <br /> absence, a regular employee will be reinstated to his former <br /> position if it still exists and the employee is not incompetent to <br /> perform the duties of the position. <br />
