410 6 .28 <br /> • Subdivision 3 . If the position no longer exists, the <br /> employee will be reinstated to a position of like status and pay, <br /> unless circumstances have so changed as to make it impossible or <br /> unreasonable. <br /> Subdivision 4 . The employee may keep his military pay. <br /> 6 .29 LEAVE OF ABSENCE WITHOUT PAY. Leave of absence <br /> without pay may be granted by the Council under the following <br /> circumstances . <br /> ( 1) A request of an employee to the Clerk-Administrator. <br /> (2) When an employee is absent from work and all accrued <br /> vacation and sick leave benefits have been paid, the <br /> Clerk-Administrator is authorized to place the <br /> employee on unrequested leave of absence without <br /> pay. Such action shall be presented to the Council <br /> for confirmation at the next regularly scheduled <br /> meeting. <br /> An employee shall not be placed on leave of absence without pay <br /> until all accrued vacation and sick leave benefits have been paid. <br /> Such leave of absence shall not exceed a period of 90 days provided <br /> • <br /> that the same may be extended beyond such period for continued <br /> disability or other good and sufficient reasons, but in no case <br /> shall it exceed one year. <br /> During a leave of absence without pay, no benefits, i.e. vacation <br /> or sick leave, health and life insurance premium contribution, <br /> uniform allowance and vehicle and expense allowance shall be <br /> accrued or paid by the City. Such benefits shall be prorgted and <br /> if the absence is for a shorter duration than the time period in <br /> which the benefit is paid for accrued. <br /> 6.30 HOLIDAYS. (240,286) <br /> Subdivision 1. The following shall be legal holidays for <br /> all regular full-time employees and regular part-time employees on <br /> a prorata basis subject to this chapter: New Year's Day, Martin <br /> Luther King's Birthday (3rd Monday in January) , President's Day, <br /> Good Friday, Memorial Day, Independence Day, Labor Day, Veteran's <br /> Day, Thanksgiving Day, Day after Thanksgiving, and Christmas Day. <br /> If Christmas Day, New Year's Day, Independence Day or Veteran's Day <br /> falls on a Sunday, the following Monday will be considered a <br /> holiday. Employees shall observe the days herein designated as <br /> legal holidays and receive compensation as though worked, but <br /> essential operations shall be maintained by such skeleton crews as <br /> the Department Head deems necessary. An employee working on a <br /> • holiday shall receive his regular pay in addition to the holiday <br /> compensation herein given, unless he is receiving call-out pay. <br />
