• 6 .31 <br /> b. Compensatory time shall not be given to exempt <br /> employees . <br /> A payment for accrued compensatory time upon termination <br /> of employment shall be calculated at the average rate of pay for <br /> the final 3 years of employment, or the final regular rate received <br /> by the employee, whichever is higher. <br /> Subdivision 6 . Call-Out Pay. An employee called back <br /> to work after he has completed his regular work day or called out <br /> on his day off shall receive a minimum of two hours compensation <br /> at the overtime rate if total hours worked during the work week <br /> exceed 40 hours. <br /> Subdivision 7 . Pay for Part-Time Work. If an employee <br /> works on a part-time basis, that is less than 40 hours per week, <br /> his pay shall be based on the hourly rate computed from the monthly <br /> rate for the position. <br /> Subdivision 8 . Termination. If an employee is <br /> terminated prior to the completion of his original probationary <br /> period or his discharge, he shall receive no pay for any accrued <br /> vacation leave or unused sick leave benefits. <br /> • 6.32 RETIREMENT. The mandatory retirement age for <br /> employees covered by this Ordinance shall be 70 years of age. <br /> There shall be no waiver of this requirement without approval of <br /> the appointing authority. <br /> 6.33 ABSENCE PROM WORK. Except as provided by this <br /> chapter, no employee shall be paid if absent from work. <br /> 6. 34 REST PERIODS. All regular employees when working <br /> under conditions when the use of a break period is practical, shall <br /> be granted a 15 minute break period in the afternoon of each work <br /> day. Travel time, if any, will be included in the break period. <br /> 6. 35 JURY DUTY. Any employee who is required to serve <br /> as a juror or who is under subpoena as a witness in court shall be <br /> granted leave with pay while serving in such a capacity, contingent <br /> upon the employee paying to the municipality treasury the fees <br /> received for such services . When an employee is released by the <br /> Court from jury duty, and there are work hours remaining on the day <br /> of release, the employee shall report to his supervisor for work. <br /> 6 . 36 RESIDENCE. No municipal employees shall be <br /> required to become residents of the Municipality at any time. <br /> However, they are encouraged to do so. <br />
