A proposal for a new CWTS tower or antennae shall not be approved unless the <br /> applicant can document to the satisfaction of the City Council that the telecommunications <br /> equipment planned for the proposed tower cannot be accommodated on an existing or <br /> approved tower or commercial building within a one-half mile radius, transcending <br /> municipal borders, due to one or more of the following: <br /> Subd. 1. The planned equipment would exceed the structural capacity of the existing or approved <br /> tower or commercial building. <br /> Subd. 2. The planned equipment would cause interference with other existing or planned <br /> equipment at the tower or building. <br /> Subd. 3. Existing or approved towers and commercial buildings within a one-half mile radius <br /> cannot reasonably accommodate the planned equipment at a height necessary for the <br /> proposed antenna to function. <br /> 1126.05: SITING AND DESIGN REQUIREMENTS: The requirements of <br /> this section apply to all CWTS towers and antennae erected, constructed, placed, <br /> • or replaced in the City. All toers and antennae shall be designed and situated to be visually <br /> unobtrusive, shall be screened as deemed appropriate by the City Council, and shall not display <br /> advertising or signage of any type except as required by government regulation. Equipment <br /> buildings housing the Base Transceiver Station (BTS) must conform with the guidelines <br /> pertaining to accessory buildings as outlined in this Chapter of the Code and by zoning district and <br /> shall be of the same or better construction and design as the principal structure or surrounding <br /> buildings. All CWTS towers and antennae shall conform to the following design and siting <br /> criteria: <br /> Subd. 1. Setbacks: The minimum setback from any property line or public right-of-way for an <br /> antenna tower is the height of the antenna tower plus an additional five feet (5') and shall <br /> be located only in the rear yard if incidental or subordinate to a principal use. <br /> Subd. 2. Accessory Buildings: Transmitting, receiving and switching equipment shall be housed <br /> in an existing structure whenever possible. If a new equipment building is necessary, it <br /> shall be of the same.or better construction, design and appearance as the principal <br /> structure or surrounding buildings so as to minimize the impact upon the neighboring uses. <br /> The tower/antenna and equipment building shall be landscaped and screened, and <br /> surrounded with an eight foot (8')tall fence so as to prevent unauthorized entry and access <br /> to the equipment building or antenna. Barbed wire, razor wire or electrified fences shall <br /> not be permitted. <br /> i . <br /> 5 <br />
