Staff has directed the applicant to arrange for <br /> a photometric analysis of the lighting to ensure the illumination will be contained on site and <br /> shielded from passing motorists and neighboring properties. <br /> Issues: <br /> Dimensional Requirements. As discussed at your meeting on February 19, 1997, all of the <br /> dimensional requirements (building setbacks, parking lot setbacks, minimum street frontage, etc.) <br /> have been met for this project with the exception of the setback of the parking lot from Highway <br /> 10. The Commission decided to consider that side of the property facing Highway 10 as a"side" <br /> rather than a"front". As a result, the required setback would be only 5 feet. The closest point of <br /> the parking lot is 10 feet from Highway 10. <br /> Parking Requirements. The Site plan date stamped 2/12/97 indicated only eight spaces being <br /> provided. The City's parking standards require nine spaces. The site plan dated 3/26/97 indicates <br /> provision of of the required nine spaces, one of which being handicapped accessible. <br /> Drainage. The City Engineer has reviewed the drainage plans and has indicated that the total <br /> run-off from the site should decrease with the removal of the excess impervious surfaces and is <br /> satisfied with the applicant's drainage plans. MnDOT will require that the applicant obtain a <br /> permit for the work proposed in the Highway 10 right-of-way. MnDOT is also requiring that the <br /> applicant provide them with existing and proposed drainage calculations to verify that drainage <br /> will not be increasing. The applicant has informed staff that these requirements will be met. As a <br /> condition of approval of this CUP and before building permits will be issued, the applicant shall <br /> provide staff with proof of MnDOT permit approval. <br /> Roadway Easement. Because Spring Lake Road is scheduled for reconstruction and widening in <br /> 1998, staff has required the applicant to dedicate to the City a permanent 10 foot roadway <br /> easement along the east property line. This easement has been indicated on the site plan. Staff <br /> has sent a copy of the easement document to the City Attorney for review. Before the City <br /> Council acts upon this conditional use permit, the easement document will need to be executed by <br /> the applicant. <br /> Fencing and Landscaping. The applicant has indicated on the revised site plan the location of a <br /> screening fence to replace the existing, dilapidated fence sections. The fence along Spring Lake <br /> Road will not encroach into the proposed roadway easement. Staff would suggest that the fence <br /> along Spring Lake Road could be moved approximately 20 feet to the west, with the end tied to <br /> the trash enclosure, and the evergreens planted in front of it so they are visible to the houses <br /> across the street. Staff would also suggest that the three junipers in the center along the north <br /> property line be replaced by two white spruce. We are checking with the City Forester, but it <br /> would be our expectation that junipers will be more of a shrub rather than a tree, and will not <br />
