Planning Case No.481-97--Oversized Garage Conditional Use Pennit <br /> Applicant:Noel Barragan,7765 Spring Lake Road <br /> May 21, 1997 <br /> Page 2 , <br /> A two-car attached garage is currently being converted into living space leaving the property <br /> owners without a garage. Met <br /> Analysis: <br /> Section 1106.04 of the Zoning Code states that no garage shall exceed 864 square feet except by <br /> conditional use permit. With a CUP, the maximum area for a garage is 1,264 square feet. The • <br /> garage proposed by the applicant, at 1,180 square feet, is within this guideline. <br /> Section 1125.01 gives a list of criteria that must be satisfied in order for conditional use permits to <br /> be approved. This development appears to satisfy all of the criteria with the possible exception of <br /> number 2, which states that the use will be sufficiently compatible or separated by distance or <br /> screening from adjacent residential properties. The garage, which will be screened from the <br /> property to the north by a privacy fence and a grade separation, will be in full view of the properties <br /> to the east and south. The absence of screening notwithstanding, the Planning Commission finds <br /> that the proposed oversized garage should have little adverse impact upon the community including <br /> those properties immediately adjacent to the subject property. <br /> Recommendation: <br /> Approve Planning Commission Resolution No. 507-97, recommending to City Council approval of <br /> a conditional use permit for Noel Barragan, allowing a 1,180 square-foot oversized garage at 7765 <br /> Spring Lake Road, with stipulations. <br /> N:\DATA\USERS\PAMS\SHARE\DEVCASES\481-97\7765-PC.RPT <br /> a <br />
