Planning Case No.490-97--Oversized Garage Conditional Use Permit <br /> Applicant:Kenneth Newcombe,7150 Knollwood Drive <br /> May 21, 1997 • <br /> Page 2 <br /> The applicant converted a small attached garage into living space in 1994, leaving the property <br /> without a garage. Presently there are two driveways on the site, one improved to the old garage <br /> and the other unimproved that goes to the rear of the property on the north side of the house. City <br /> Code, in Section 1121.09 Subd. 5e, states that only one curb-cut shall be allowed per single-family <br /> property. Staff asks the Planning Commission for guidance regarding the enforcement of this <br /> provision. The attached photo documentation shows the southeast and northeast elevations. <br /> Staff has become aware of a nuisance code violation on the Newcombe property, which was <br /> verified with a recent site visit. In the rear yard, there is an accumulation of bagged pop cans which <br /> are waiting to be recycled. In addition to the cans, there are plastic barrels and pails in the same <br /> location. The cans are visible from Woodale Drive to the south. While the property owner would <br /> prefer to recycle the cans when the price-per-pound increases, staff suggests that the cans, barrels <br /> and pails be removed prior to the granting of this conditional use permit by the City Council. <br /> Dimensional Requirements: <br /> Required provided Met/Not Met <br /> Garage Setbacks* (Front) 110 feet 150 feet Met <br /> (Side) 5 feet 8 feet Met <br /> (Rear) 5 feet 310 feet Met • <br /> Percent of Rear Yard* <25% 2.5% Met <br /> Garage Width s 35 feet 32 feet Met <br /> Area of all Accessory Buildings: s 1,264 Sq. ft. 1,264 Sq. ft. Met <br /> Analysis: <br /> Section 1106.04 of the Zoning Code states that no garage shall exceed 864 square feet except by <br /> conditional use permit. With a CUP, the maximum area for a garage is 1,264 square feet. The <br /> garage proposed by the applicant, at 1,264 square feet, meets this requirement Section 1125.01 <br /> gives a list of criteria that must be satisfied in order for conditional use permits to be approved. <br /> This development appears to satisfy these criteria. Also in Section 1125.01, the Planning <br /> Commission is to examine the possible adverse affects of the oversized garage. Using the factors <br /> listed in the Code, the proposed use will have little if any adverse impact upon surrounding <br /> properties. <br /> Recommendation: <br /> Approve Planning Commission Resolution No. 506-97, recommending to City Council approval of <br /> a conditional use permit for Kenneth Newcombe, allowing a 1,264 square-foot oversized garage at • <br /> 7150 Knollwood Drive, with stipulations. <br /> N:\DATA\USERS\PAMS\SHARE\DEVCASES\480-97\7150-PC.RPT <br />
