21, 2004, the City has received a total of seventeen (19) responses - sixteen (16) <br />marked as being generally in favor of the project, two (2) generally opposed, and <br />one (1) not sure. <br /> <br />Curb and Gutter <br />In the area west of Silver Lake Road, all except two responses indicated that <br />they would prefer concrete curb and gutter. One prefers bituminous curb and <br />gutter and the other does not want any curbs. Given that the estimated cost to <br />provide concrete curb, gutter, and driveway apron is less than $122,000, value <br />and longevity are increased, and the community supports the provision of such, <br />Staff is recommending that the project include concrete curb, gutters, and <br />driveway aprons. <br /> <br /> <br />Rice Creek Watershed District Permit Requirements <br />On December 18, 2003, Staff met with representatives of the Rice Creek <br />Watershed District to discuss any requirements they may pose on this project. As <br />a result of that meeting two infiltration basins were added to the project and three <br />underground structures were also added to treat storm water prior to being <br />discharged into Spring Lake. The estimated cost of these items is $109,300. The <br />Rice Creek Watershed District has not issued a permit for this project as of yet. <br />The City typically makes an application at the time the plans are completed. <br />Therefore, there is no guarantee that the District will approve the water infiltration <br />and quality measures as currently proposed. <br /> <br /> <br />Silver Lake Woods Condominiums – Dedication of Private Streets <br />On May 6, 2002 the issue of dedication of private streets was discussed at a City <br />Council Work Session. The City Council seemed to somewhat agree on the <br />proposed policy: however, no action was taken. On July 11, 2002, Staff met with <br />Cliff Ash and Mike Berke of the Silver Lake Woods Homeowners Association, <br />outlining the requirements the City would be looking for in order to dedicate their <br />streets to the City. <br /> <br />The City received a proposed draft agreement for Public Dedication of Streets <br />and Utilities, drafted by J. Patrick Brinkman of the law firm Felhaber, Larson, <br />Fenlon, & Vogt dated December 2, 2002. A copy was also forwarded to the City’s <br />legal counsel, Scott Riggs. <br /> <br />Should this project proceed, and based on City Council’s direction, Staff will <br />facilitate meetings with the Homeowners Association and their legal counsel to <br />identify and discuss any and all issues associated with dedication of private <br />streets. The last time this topic was discussed with the Council was at the Work <br />Session on May 6, 2002. <br /> <br /> <br /> <br />
