Mounds View City Council September 13, 2004
Regular Meeting Page 4

Council Member Stigney stated it would go back to the Charter Commission. 1
2
Jonathan Thomas, Chair of the Charter Commission, stated that it would not go to a ballot, and it 3
would go back to them with a request for some modification or with some request to rework a 4
section, and then they would re-present it for a unanimous ballot. 5
6
Mayor Linke stated he did not foresee a problem with it since it passed unanimously on the first 7
vote. 8
9
City Clerk/Administrator Ulrich added that this is a total rewrite of Chapter 5, and that the City 10
Attorney had reviewed it in terms of form and consistency with state statute, and it met with his 11
approval. 12
13
Mayor Linke closed the public hearing. 14
15
B. 7:10 pm: Public Hearing for Second Reading and Adoption of Ordinance 742, Amending 16
Section 2.06 of the City Charter regarding Mayor’s Powers and Duties. (Roll Call Vote) 17
18
Mayor Linke opened the public hearing. 19
20
Mayor Linke stated that this basically added one sentence. 21
22
Council Member Marty stated he thought it was excellent. 23
24
Mayor Linke stated he had no problem with it. 25
26
Mayor Linke closed the public hearing. 27
28
C. 7:15 pm: Public Hearing for Second Reading and Adoption of Ordinance 748, Amending 29
Section 4.05 of the City Charter regarding Vacancy of Municipal Elected Office. (Roll Call 30
Vote) 31
32
Mayor Linke opened the public hearing. 33
34
Mayor Linke stated the word “highest” was added, and the sentence, “Candidates filling a 35
vacancy shall take office before the next regularly scheduled Council meeting following election 36
certification.” He stated there is one Council member running for Mayor in this election, and he 37
asked Mr. Thomas whether this would take effect if he is elected. 38
39
Mr. Thomas stated that this change would be nothing in that case because there isn’t an open seat 40
until he is elected, and because that seat is not open now, that would force a special election. He 41
stated there are questions about when and why we would have to have a special election, which 42
aren’t being addressed here. 43
44
Mayor Linke closed the public hearing. 45
