Mounds View City Council September 13, 2004 <br />Regular Meeting Page 4 <br /> <br />Council Member Stigney stated it would go back to the Charter Commission. 1 <br /> 2 <br />Jonathan Thomas, Chair of the Charter Commission, stated that it would not go to a ballot, and it 3 <br />would go back to them with a request for some modification or with some request to rework a 4 <br />section, and then they would re-present it for a unanimous ballot. 5 <br /> 6 <br />Mayor Linke stated he did not foresee a problem with it since it passed unanimously on the first 7 <br />vote. 8 <br /> 9 <br />City Clerk/Administrator Ulrich added that this is a total rewrite of Chapter 5, and that the City 10 <br />Attorney had reviewed it in terms of form and consistency with state statute, and it met with his 11 <br />approval. 12 <br /> 13 <br />Mayor Linke closed the public hearing. 14 <br /> 15 <br /> B. 7:10 pm: Public Hearing for Second Reading and Adoption of Ordinance 742, Amending 16 <br />Section 2.06 of the City Charter regarding Mayor’s Powers and Duties. (Roll Call Vote) 17 <br /> 18 <br />Mayor Linke opened the public hearing. 19 <br /> 20 <br />Mayor Linke stated that this basically added one sentence. 21 <br /> 22 <br />Council Member Marty stated he thought it was excellent. 23 <br /> 24 <br />Mayor Linke stated he had no problem with it. 25 <br /> 26 <br />Mayor Linke closed the public hearing. 27 <br /> 28 <br /> C. 7:15 pm: Public Hearing for Second Reading and Adoption of Ordinance 748, Amending 29 <br />Section 4.05 of the City Charter regarding Vacancy of Municipal Elected Office. (Roll Call 30 <br />Vote) 31 <br /> 32 <br />Mayor Linke opened the public hearing. 33 <br /> 34 <br />Mayor Linke stated the word “highest” was added, and the sentence, “Candidates filling a 35 <br />vacancy shall take office before the next regularly scheduled Council meeting following election 36 <br />certification.” He stated there is one Council member running for Mayor in this election, and he 37 <br />asked Mr. Thomas whether this would take effect if he is elected. 38 <br /> 39 <br />Mr. Thomas stated that this change would be nothing in that case because there isn’t an open seat 40 <br />until he is elected, and because that seat is not open now, that would force a special election. He 41 <br />stated there are questions about when and why we would have to have a special election, which 42 <br />aren’t being addressed here. 43 <br /> 44 <br />Mayor Linke closed the public hearing. 45
