Mounds View City Council November 8, 2004 <br />Regular Meeting Page 6 <br /> <br />Director Ericson stated that this item was brought to the Council’s attention at the November 1st 1 <br />work session, and that this ordinance puts into play some regulations and mechanisms by which 2 <br />the city can recover costs incurred in the event of a drug lab cleanup. He stated that although 3 <br />there has not been a problem in Mounds View in this regard, other cities had had problems. He 4 <br />stated that this merges the ordinances from New Brighton and Coon Rapids that would give the 5 <br />city added protection. He stated the ordinance as drafted would allow for cost recovery in the 6 <br />vent that the cleanup extends off site, or if the neighboring property owners are displaced or have 7 <br />to be evacuated. He stated that it is appropriate to go after the property owner if the tenant or 8 <br />guest is causing the problem, because the City Attorney has indicated it’s the most appropriate 9 <br />method to recover costs, and then the property owner would have the right to recover those costs 10 <br />back from the individual who may have rented the facility, or was a guest in a motel, and that is a 11 <br />risk that anybody who has rental property has. 12 <br /> 13 <br />MOTION/SECOND: Marty/Gunn. Resolution 6372, Approving Mermaid Request for Reimbursement of Leasehold 19 <br />Improvements. 20 <br /> 21 <br />City Clerk/Administrator Ulrich stated that lien waivers had been received from OEB for the 22 <br />furniture and office work that was done, and there had been a Waiver of Mechanic’s Lien 23 <br />provided for the carpet work that was done. He stated the final amount is $6,678, and that 24 <br />reimbursement is not legally required, but staff believes it would be a good business practice. 25 <br /> 26 <br />Mayor Linke asked if that amount was before or after the damage deposit was deducted, and City 27 <br />Clerk/Administrator Ulrich stated that that was after. 28 <br /> 29 <br />Mayor Linke read the resolution aloud. 30 <br /> 31 <br />Council Member Stigney asked what Invoices 16855 and 16856 were for. 32 <br /> 33 <br />Council Member Gunn said they were for walls and panels and connectors. 34 <br /> 35 <br />MOTION/SECOND. Gunn/Marty. To adopt Resolution 6372, Approving Mermaid Request for 36 <br />Reimbursement of Leasehold Improvements. 37 <br /> 38 <br />Council Member Stigney stated he would not support this because the Mermaid had cost them a 39 <br />lot of money by bowing out of the lease two months early and taking all the bookings for the next 40 <br />year. He stated it’s costing the city $2,000 a month for the new lease. 41 <br /> 42 <br />Council Member Quick stated he feels the same way Council Member Stigney does, and that it’s 43 <br />not a legal obligation to reimburse the leasehold improvements. 44 <br /> 45
