change order but delete the portion where the sidewalk crosses Spring Creek. <br />At the September 8, 2003 meeting the City Council proposed a fifth option – <br />Option 5. This option was to award the contract for the Bid Alternate only and <br />add in the segment of sidewalk from Knollwood Drive to Silver Lake Road as a <br />change order – Redefining the scope of the project from Silver Lake Road to the <br />West City Limits. <br /> <br />The City Council then awarded the construction contract for only the Bid <br />Alternate - Knollwood Drive to the West City Limits. <br /> <br /> <br />Discussion: <br />Since the Base Bid was not awarded, Staff consulted the City’s Engineering <br />consultant and legal consultant. Both entities confirmed that the City Council <br />cannot award the Bid Alternate without awarding the Base Bid – thus making <br />Option 5 invalid. <br /> <br />Given this, only the original four options remain. Should the City Council wish to <br />redefine the scope of the project; from Silver Lake Road to the West City Limits, <br />the City Council must select Option 1 - Do Not Award a Contract. The City would <br />then need to reject the bids and re-advertise. Since the construction season is <br />near its end, the project would then become a 2004 construction project. <br /> <br />Staff would like to point out that the bids received from the low bidder, Ti-Zack <br />Concrete, were considerably lower than the other three bidders. Knowing that they were so much lower than the other bidders, Ti-Zack <br />Concrete could easily raise their bid items in the spring of 2004 and still remain <br />the low bidder. Staff would like to make it clear that there is no guarantee that the <br />City will receive favorable bids in 2004. <br /> <br />Bridge option <br /> At the September 8, 2003 meeting, the City Council inquired as to the feasibility <br />of a bridge being utilized to span Spring Creek, as opposed to the use of sheet <br />piling.
