Mounds View City Council Page Six <br /> 0 Regular Meeting May 23 , 1994 <br /> Mayor Linke indicated that the City had met with Rice Creek Watershed <br /> District on the site to delineate a place for the creation of the ponding <br /> area. <br /> Orduno read contingency 2 , from Resolution No. 4572 which states, "The <br /> proposed Storm Water Control Plan shall be approved by both the City <br /> Consulting Engineer and the Rice Creek Watershed District. " <br /> Mayor Linke closed the public hearing at 7 : 49 p.m. <br /> Harrington stated that Resolution No. 4572 approves the development <br /> request subject to all contingencies attached to it. <br /> Councilmember Trude moved Resolution No. 4572 deleting contingency number <br /> 3 . Seconded by Councilmember Wuori. <br /> Mayor Linke stated that he had another amendment to the resolution <br /> regarding water issues. Linke asked that contingency number 4 state that <br /> the development agreement approval be contingent upon successful <br /> resolution of the wetland issues. <br /> Councilmember Trude asked if time was critical regarding this resolution <br /> • or could this resolution be delayed until Rice Creek Watershed determined <br /> the resolution of the wetland issue. <br /> Orduno explained that Westminster had to submit the approval from the <br /> City by June 3 to the Minnesota Housing and Finance Agency as the company <br /> receives points for each action taken regarding tax credits. <br /> MOTION/SECOND: Trude/Wuori to Adopt Resolution 4572 Approving the <br /> Development Agreement Request of Westminster Corporation As Amended <br /> Orduno stated that a contingency should be added that states that the <br /> Development Agreement is approved contingent upon the successful <br /> —r&solution o -wetl-end---issu-ems-. <br /> Councilmember Trude stated that she amended the resolution to delete <br /> contingency number 3 regarding a safe crossing because it is impossible <br /> to hold the developer liable for ensuring a safe crossing of County Road <br /> I . <br /> Councilmember Wuori as liaison to the Planning Commission stated that <br /> this item came up at the Planning Commission and a sidewalk on the north <br /> side of County Road I was one of the selling points of the project was to <br /> be able to access the park from the project via sidewalk. Wuori <br /> indicated that there is no sidewalk that goes down the driveway to the <br /> road where persons could cross the road to the park. Wuori stated that <br /> the idea was to provide for a sidewalk where persons would not have to <br /> 411 walk on the driveway or road to the corner. <br />
