Mounds View City Council Page 6 <br /> 411 Regular Meeting November 29, 1994 <br /> MOTION/SECOND: Wuori/Trude to Adopt Resolution No. 4670 Approving <br /> a Conditional Use Permit for Dennis Patterson, 8121 Edgewood Drive, <br /> to Allow for the Construction of an Oversized Accessory Building <br /> Councilmember Trude asked if there had been an on-site inspection. <br /> Harrington affirmed there had been. <br /> VOTE: 5 ayes 0 nays Motion Carried <br /> Consideration of Request for a Wetland Alteration Permit, for Louis <br /> Downing, Woodale and Longview <br /> Mayor Linke opened the public hearing at 7: 15 p.m. <br /> Paul Harrington, Community Development Coordinator, explained that <br /> Louis Downing, the owner of Lot 2, Block 1 of Downing Addition, has <br /> made application for a Wetland Alteration Permit. Mr. Downing is <br /> in the process of selling this property to a potential buyer based <br /> on whether the lot is buildable or not. The Wetland Zoning <br /> Ordinance requires that a Wetland Alteration Permit be issued for <br /> the construction, alteration, or removal of any structure in or <br /> upon a Wetland Zoning District. Mr. Downing's property is <br /> 411 primarily within the Wetland Buffer Zone, which is a 100 foot strip <br /> that surrounds the wetlands. The City has a controlling interest <br /> in those Buffer Zones because of the potential impacts on the <br /> wetlands themselves. In Mounds View, those wetlands are used for <br /> storm water retention and detention and they play an important role <br /> in the storm water management plans of the City. For that reason, <br /> a public hearing is required. <br /> Harrington said this item had been reviewed by himself as well as <br /> by Rocky Keene, the City Consulting Engineer, for compliance with <br /> the Municipal Code. Harrington commented that the City Consulting <br /> Engineer did not see a problem with the home being constructed on <br /> th- e pr-oper-ty. —It should not adversely -a-ftect—the wetland itse1f.—_—__ <br /> However, the applicant has indicated on a site plan some additional <br /> landscaping and clearing of the property and installing of sod. <br /> Harrington and the City Consulting Engineer both felt that would <br /> not be in the best intentions of the Code. He explained that the <br /> Code does not encourage the elimination of natural vegetative cover <br /> in the areas of wetlands and that includes the Buffer Zones. <br /> Harrington said that he and the City Consulting Engineer had <br /> reviewed the issues of storm water runoff and the impacts to the <br /> wetland. With the use of an overhead projector, Harrington <br /> presented a map which indicated the location of the property at <br /> Longview and Woodale Drive, noting that the map had been forwarded <br /> to him by the prospective buyer and not by the applicant. This map <br /> showed the proposed location of the home in relation to the wetland <br /> and the 100 foot Wetland Buffer Zone. He pointed out that the City <br />
