<br />. <br /> <br />. <br /> <br />. <br /> <br />MOUNDS VIEW PLANNING COMMISSION <br />RESOLUTION NO. 137A-85 <br />PAGE TWO OF THREE <br /> <br />WHEREAS, the engineers recommend a curb cut for this car wash <br />and a separate curb cut for the vacant lot to the south when it is <br />developed; and <br /> <br />WHEREAS, state law states that if the Comprehensive Land Use <br />Plan and the zoning disagree, the zoning on a lot controls the land <br />use; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning <br />Commission recommends approval of the request by Ronald L. <br />Richardson and amend the Comprehensive Land Use Plan to reflect this <br />use; <br /> <br />BE IT FURTHER RESOLVED that a development agreement be <br />entered into between the City and the developer which includes the <br />following: <br /> <br />1. Exhibits: <br /> <br />a) Site, Grading and Utility Plan <br />b) Development Plan <br />c) Site Survey <br />d) Legal Description <br />e) Ordinance No. 49A 7-Year Performance Bond <br />of $1,000 <br />f) Building Plans and Specifications <br />g) Landscaping Plan <br /> <br />2. Security for the development in an amount to be <br />determined. <br /> <br />3. Exhibit 2A to require the following: <br /> <br />a) Paved parking area to use B-6-18 curbing <br /> <br />b) Ten feet of landscaping and screening at the <br />boundaries of the residential district. <br /> <br />c) Ten feet maximum height on light at north end of the <br />lot. <br /> <br />d) Approval from MnDOT for access to Highway 10. <br /> <br />e) Payment of all City expenses above and beyond <br />amounts previously submitted <br /> <br />f) Other items as may be required by the City Council. <br /> <br />BE IT FURTHER RESOLVED that the Mounds View Planning <br />Commission recommends that a conditional use permit be granted which <br />includes the above items and the following items: <br />
