Ric Minetor, Director of Public Works/City Engineer, reviewed <br />Staff Report No. 92-234C regarding Resolution No. 4217 a Request <br />for Variance, 2673 Sherwood Road, MacMay Homes. Minetor stated <br />that MacMay Homes, Inc. requested a variance to allow the <br />construction of a single family home at 2673 Sherwood Road, with <br />a side yard setback of five feet where a ten foot setback is required <br />by Municipal Code and a front yard set back of 30.5 feet where a <br />setback of 58 feet is required by a previous planning action. <br />Steven May, 2359 Pinewood Circle, stated that he is a general <br />contractor who builds houses in several communities and understands <br />why sideyard setbacks are set. Mr. May described how this home <br />would fit. on the property and why the variance was being requested. <br />In this particular situation, the rear yard would face the sideyard <br />setback. <br />• Mr. May had received a visit from the adjoining neighbor to this <br />property who had some concerns. After discussing the concerns with <br />Mr. May. the neighbor stated to Mr. May that he felt much better about <br />the variance and placement of the home on the property. <br />Councilmember Rickaby was concerned that with the setbacks as shown, <br />the homeowner would have difficulty getting to his rear yard. <br />Rickaby stated there had been a problem with a homeowner that could not <br />drive to his backyard and, therefore, drove across a wetland. <br />Mr. May stated that this lot has a 25' drain easement on <br />the property and this makes the building pad for the home only 45'. <br />Mr. May stated that this makes the selection of the type of home and <br />the price of the home difficult because of the small area to build on. <br />Councilmember Rickaby stated that this hardship was self created by <br />the developer as he wanted to make the lots small. Councilmember <br />Rickaby stated that she is against this variance as this situation <br />could set a precedence. <br />Mayor Linke stated that it will be impossible for the homeowner to <br />get to his backyard as he will not be able to encroach on the 25' <br />drainage easement. Mayor Linke stated that the original developer <br />did the plotting and the City made an error in not noting that this <br />was a non-standard sized lot. Linke further stated that a 45' pad is <br />hard to build on. <br />
