Ric Minetor, Director of Public Works/City Engineer, reviewed Staff Report No. 92-234C regarding Resolution No. 4217 a Request for Variance, 2673 Sherwood Road, MacMay Homes. Minetor stated that MacMay Homes, Inc. requested a variance to allow the construction of a single family home at 2673 Sherwood Road, with a side yard setback of five feet where a ten foot setback is required by Municipal Code and a front yard set back of 30.5 feet where a setback of 58 feet is required by a previous planning action. Steven May, 2359 Pinewood Circle, stated that he is a general contractor who builds houses in several communities and understands why sideyard setbacks are set. Mr. May described how this home would fit. on the property and why the variance was being requested. In this particular situation, the rear yard would face the sideyard setback. • Mr. May had received a visit from the adjoining neighbor to this property who had some concerns. After discussing the concerns with Mr. May. the neighbor stated to Mr. May that he felt much better about the variance and placement of the home on the property. Councilmember Rickaby was concerned that with the setbacks as shown, the homeowner would have difficulty getting to his rear yard. Rickaby stated there had been a problem with a homeowner that could not drive to his backyard and, therefore, drove across a wetland. Mr. May stated that this lot has a 25' drain easement on the property and this makes the building pad for the home only 45'. Mr. May stated that this makes the selection of the type of home and the price of the home difficult because of the small area to build on. Councilmember Rickaby stated that this hardship was self created by the developer as he wanted to make the lots small. Councilmember Rickaby stated that she is against this variance as this situation could set a precedence. Mayor Linke stated that it will be impossible for the homeowner to get to his backyard as he will not be able to encroach on the 25' drainage easement. Mayor Linke stated that the original developer did the plotting and the City made an error in not noting that this was a non-standard sized lot. Linke further stated that a 45' pad is hard to build on.
