~J <br />Mounds View City Council <br />Regular Meeting <br />Page 11 <br />June 26, 1995 <br />Councilmember Trude questioned the status of the Silver Lake <br />Woods Fund which has been used for several years to cover the <br />cost of sealcoating and preventative maintenance, Mr. Ulrich <br />responded it is almost depleted <br />Marlene Westphal, 8232 Greenwood Drive, advised she owns a <br />corner lot and believes they are being discriminated against <br />by having to pay an assessment on both lots. She reported <br />their request for locating an accessory building was refused <br />which makes her feel like the owners of corner lots do not <br />have the right to use their property and make improvements, <br />are taxed at a higher rate and are asked to pay for two <br />streets. <br />Mr. Ulrich reviewed how corner lots are proposed to be <br />assessed, advising Ms. Westphal would be assessed for 100% of <br />the adjusted front footage on Greenwood and 25% of the <br />adjusted front footage of Arden. <br />Ms. Westphal restated her objection to being assessed twice <br />and asserted it is not a privilege to own a corner lot. <br />Duane McCarty, 8060 Long Lake Road, pointed out he had raised <br />some questions at the last meeting and would have appreciated <br />a courtesy call and receiving staff's recommendations prior to <br />the meeting so he had time for review in detail. He asserted <br />the proposed action of the assessment policy will result in <br />circumventing resident's ability to have any meaningful input <br />on this issue. He stated he can not comment on the rest since <br />he did not receive a copy for review to determine if the <br />proposed policy is in full compliance with City Charter, as he <br />views it. <br />Mr. McCarty commented the tenants of the Charter were included <br />because there are things residents want like a long-term <br />finance plan, long-term CIP, etc. He reviewed the history of <br />adoption of Chapter 202, the current assessment policy, and <br />expressed concern that it merges properly with proposed <br />Chapter 560. He advised he wants to be sure the Council <br />understands all the tenants of Chapter 202 and that it is not <br />being ignored or they are not aware of it. <br />Mr. McCarty questioned how the Council intends to coordinate <br />proposed Chapter 560 with existing Chapter 202. <br />Mayor Linke explained he reviewed both chapters and determined <br />Chapter 202 is more broad where Chapter 560 contains actual <br />policy on how assessments would be developed as to percentage. <br />Chapter 560 also deals with lot shapes and gets down to <br />• specifics and numbers where Chapter 202 does not.
