Point of clarification: All references to the <br /> position of Clerk-Administrator are abbreviated as CA. Don <br /> Brager's comments on Chapters 7 and 8 are also attached to this <br /> memorandum. <br /> Section 6. 01 <br /> If the CA is appointed to "assist in the administration of City <br /> affairs" , and the list of the position duties is detailed, then <br /> for the purpose of consistency, consideration may need to be <br /> given as to what the Council's role in that administration shall <br /> be. <br /> Section 6. 02 , Subd. 1 <br /> While the original intent may have been to give tacit consent to <br /> the CA delegating duties, the language here is contradictory to <br /> that "intent" . <br /> Subd. 2 <br /> The City Council formally appoints all employees, full-time and <br /> part-time, upon recommendation from the CA. Determinations as to <br /> qualifications, job descriptions, skills testing, interview <br /> procedures and reference checks are generally delegated to the <br /> CA. <br /> Personnel Administration is perhaps one of the mostcomplex <br /> professions today. In the public sector with the restrictions and <br /> regulations put forth bysuchlaws as Veteran's Preference, <br /> American Disabilities Act, Human Rights legislation andlabor <br /> relations, it is difficult for a City Council to keep abreast of <br /> the almost daily changes that are mandated in the area of <br /> personnel.
